The deadline for bid submission is May 19, 2026, at 2:30 p. m. PDT. The anticipated time to complete the requested services will be part of the scoring criteria, but the post-contract notice to proceed will not be issued until the Port has secured funding. The contract execution date is anticipated to be June 30, 2026, with a final completion date to be determined during contract negotiations.

The bid notice states that payments shall be made monthly based on satisfactory completion of work milestones. The Port reserves the right to withhold up to five percent of the payment as retainage. Progress payments are due within twenty-one days of approval, and late payments will incur interest at nine percent per annum. Final payment will be made after final completion and submission of all required closeout documents.

The contract states that the contractor warrants to the owner that the construction, including all materials and equipment, shall be new unless otherwise specified, of good quality, in conformance with the contract documents, and free of defects in materials and workmanship. This warranty excludes defects caused by abuse, alterations, or failure to maintain the work. The contractor agrees to correct any work found to be non-conforming within one year from the date of substantial completion.

The Port will award the contract to the responsible bidder submitting a responsive bid at the lowest cost. If all responsive bids exceed the Port's cost estimate, the Port reserves the right to negotiate with the lowest bidder.

To be eligible for consideration, bidders must be registered with the Oregon Construction Contractors Board. Bidders must also provide a project team with resumes, describe three completed projects demonstrating experience in the requested work, and provide a project schedule and cost. The successful bidder must provide documentation of all required licenses.

The contract includes liquidated damages for failure to achieve substantial completion by the specified date (**** per day) and for failure to achieve final completion by the scheduled date (**** per day). The Port also reserves the right to terminate the contract for cause if the contractor fails to meet its obligations, which could result in the contractor being liable for costs and expenses incurred by the Port in completing the work.

A mandatory pre-bid meeting will be held at the Pier 3 Boatyard office. Additional inspections may be scheduled by contacting Matt McGrath at least 48 hours in advance.
