Contractors must be licensed in the state of Tennessee and have documented experience with commercial aquac facility renovations, commercial pool plumbing systems, and commercial pool resurfacing. Company name must be on the pre-bid attendee list to be eligible. Bidder must be a licensed contractor in the state of Tennessee, as required by the Contractors Licensing Act of ****, State of Tennessee.

If the successful vendor fails to execute required contracts, the bid bond will be forfeited. If the successful vendor fails to furnish payment and performance bonds and execute a contract within the allowed time, the bid bond deposit will be retained as liquidated damages. If the successful vendor fails to execute required contracts, the security will be forfeited.

Samples, if required, will be furnished at no charge to the city and will remain in the purchasing department for testing and evaluation until an award is made. Samples, if required, will be furnished at no charge to the city.

Any protest to the award of a contract must be submitted in writing to the director of purchasing with a copy to the city manager and delivered no later than seven calendar days from the date of the city's award decision. Failure to comply with the drug-free workplace affidavit requirement will declare the bid nonresponsive. Not being on the pre-bid attendee list will make a bidder ineligible to bid. Failure to comply with this requirement will declare that bid nonresponsive.

All contracted personnel, regardless of nationality, will be required to pass a background investigation conducted by the contractor and a separate background investigation conducted by the U. S. government to certify their suitability for employment under this contract.

All work must be completed within 60 calendar days from the date of the contract award.

All workmanship and materials shall be warranted for a minimum of one year from the date of acceptance.

The contract will be awarded to the responsible offeror whose proposal is determined to be the lowest price technically acceptable (LPTA) and most advantageous to the government.

Contractor shall ensure that all work is performed by skilled tradespersons who are fully qualified, licensed, and experienced in their respective fields.

Failure by the contractor to conduct a site visit prior to submitting a proposal does not relieve the contractor of responsibility for properly estimating the difficulty or cost of successfully performing this work.
