Payments for services will not be made in advance of work performed. The state of Delaware may require holdback of contract monies until acceptable performance is demonstrated, as much as 25%. All contract costs must be as detailed specifically in the vendors cost proposal.
The vendor will provide a warranty that the deliverables provided will function as designed for a period of no less than one year from the date of system acceptance. The warranty shall require the vendor correct, at its own expense, the setup, configuration, customizations or modifications so that it functions according to the states requirements.
The contract will be awarded to the vendor whose proposal is most advantageous to the State of Delaware, considering experience and reputation (25%), capacity to meet requirements (25%), demonstrated expertise in a person-centered service model (10%), full understanding of guardianship alternatives (10%), and project cost (20%). The contract shall be awarded to the vendor whose proposal is most advantageous, taking into consideration the evaluation factors set forth in the rfp.
Vendors must provide Delaware licenses and/or certifications necessary to perform services, complete all appropriate attachments and forms, and provide proof of insurance. Prior to the execution of an award document, the successful vendor shall either furnish the agency with proof of state of delaware business licensure or initiate the process of application where required.
The State of Delaware may include in the final contract liquidated damages provisions for nonperformance. If any vendor fails to comply with a through e noted above of this paragraph, the state of delaware reserves the right to disregard the proposal, terminate the contract, or consider the vendor in default.

Vendors risk disqualification if they fail to respond to requests for information, submit proposals after the deadline, make direct contact with state employees other than the designated contact, have been convicted of certain offenses indicating a lack of business integrity, or violate contract provisions. Vendors directly contacting state of delaware employees risk elimination of their proposal from further consideration.
