This is a 5-year tiered indefinite delivery indefinite quantity contract for polytray entrée items for UGRHS and UGRE programs. The contract is firm fixed price with economic price adjustments. Offers must be technically acceptable and the lowest price. Product demonstration models (PDMs) are required and must be submitted by the closing date. Delivery is FOB destination to Depot Tracy, CA. The government guarantees the minimum contract quantity of 1,201,900 ea. The required shelf life is 36 months.
Required delivery dates shall not exceed 120 days after issuance of each delivery order.
Payment for an adjustment under this epa language shall be at the current contract price until an adjustment modification has been effected.
For the portion of the schedule that is covered by this epa language, the contractor warrants that the unit prices included in the schedule do not include allowances for any portion of the contingency covered by this epa language.
The government will award an indefinite delivery contracts resulting from this solicitation to the responsible offerors whose offer conforms to the solicitation and will be most advantageous to the government, price and other factors considered.

The government reserves the right to conduct physical surveys of the plants, which are to be used in the performance of a contract.
A total of 30 samples of pdm items shall be submitted as stated below.

A contractor may be suspended and or debarred for knowing failure by a principal to timely disclose to the government, in connection with the award, performance, or closeout of a government contract performed by the contractor or as subcontract awarded there under, credible evidence of a violation of federal criminal law involving fraud, conflict of interest, bribery, or gratuity violations found in title 18 of the united states code or a violation of the false claims act.
