To be eligible for award, you must have the capability in all respects to perform fully the contract requirements and the integrity and reliability which will assure good faith performance. We may also consider a documented commitment from a satisfactory source that will provide you with a capability. We may consider information from any source at any time prior to award.
The bid notice mentions that improperly requesting a preference can have serious consequences. It also states that violation of prohibited communications and donations restrictions may result in disqualification of your offer, suspension or debarment, and may constitute a violation of law. If you violate the provision regarding substitutions prohibited for end product preferences, the state may terminate your contract for cause and you may be debarred.
