Bids are due by August 6, 2026, at 2:00 PM Eastern. The contract performance period is 365 calendar days from the notice to proceed.

Payments shall be made to the contractor within thirty (30) calendar days of receipt of invoice after inspection and acceptance of services.

Bidders shall unconditionally guarantee the items and workmanship being bid. If any defects are noted, the bidder shall replace items at their expense.

The award will be made to the responsible bidder meeting specifications with the lowest possible cost, considering quality, service, technical capability, and delivery. The award will be made to the responsible seller whose bid conforms to the solicitation that is most advantageous to the buyer on basis of price, technical capability, and delivery.

The city may investigate the bidder's ability to furnish goods/services, including financial statements, references, and past performance records. The city reserves the right to reject any bidder if the evidence fails to satisfy the city that such bidder is properly qualified to carry out the terms of this bid.

Liquidated damages may apply if the bidder fails to deliver supplies or perform services within the time specified. If the bidder fails to deliver the supplies or perform the services within the time specified in the contract, the bidder shall, in place of actual damages, pay to the city of myrtle beach liquidated damages of na per calendar day of delay.

A mandatory pre-bid meeting is required. Additional site visits may be scheduled at no cost to the city after attending the mandatory meeting.

A bidder with a concern must inform the procurement agent within five (5) calendar days after the city posts a bid tab or awards the contract. Formal protests must be filed within five (5) calendar days of discussing the dispute with the procurement agent.

Disqualification may occur due to collusion, attempts to improperly influence evaluation teams, inability to complete responsibilities, or existing lawsuits/disputes with the city.

The county reserves the right to award in whole or in part to the lowest responsible bidder, or to award each item separately to the lowest responsible bidder meeting specifications, or to make an award based on the total bid to the bidder whose total sum is the low bid meeting the specifications, whichever is in the best interest of the county.

Respondent must be an established concern in the business of providing the product/service proposal and must prove to the county purchasing agent's satisfaction, upon request, that they have adequate facilities to perform all requirements in the event of an award.

There may be deducted from the amount payable to the contractor a penalty of **** for each person for each calendar day during which such person is discriminated against or intimidated in violation of the contract provisions.

Site inspections for county buildings can be arranged by calling the Superintendent of Buildings and Grounds or authorized representative for information or questions at ****.

Any prospective bidder who wishes to challenge a bid specification shall file such challenges in writing with the contracting agent no less than three (3) business days prior to the opening of the bids.

Bids containing any conditions, omissions, unexplained erasures or alterations, items not called for in the bid proposal form, attachments of additive information not required by the specifications, or irregularities of any kind, may be cause for rejection by the owner.
