The electronic bid submittal deadline is Tuesday, June 30, 2026, at 1:00 PM CST. No proposal will be accepted after this date and time unless in the best interest of NOLAPS by an addendum notification.

Invoices will be paid based upon receipt of material or properly executed invoice, whichever is later. Payment will be made on the basis of unit price as listed in the blanket order. In no case will the OPSB refuse to make partial payments to the bidder although all items have not been delivered.

Awards will be made to the responsible vendors whose proposals are determined after evaluation by NOLAPS to be the best value to NOLAPS. The bid will be awarded to the lowest responsible and responsive bidder that meets or exceeds the specifications/scope of work.

To qualify for evaluation, a proposal must have been submitted sealed and on time and must materially satisfy all mandatory requirements identified in this document. Specifications and qualification documents may be obtained by visiting the districts website at www. ***. *. *

If the bidder fails to meet the requirements or to deliver articles within the time specified elsewhere in these specifications, the board reserves the right, without prior notice or putting in default but by mere lapse of time, to obtain the articles from any other person or firm at such price as may be charged without competitive bids. The difference between the price paid and the contract price shall be deducted from the following or any subsequent payment to the contractor.

When called for, samples shall be submitted with the bid per instructions set forth in the special terms and conditions if applicable. Additional samples needed for a bid to be evaluated properly shall be delivered within 5 business days from the time the proposer is notified by the purchasing department. Sample items from the successful proposer may be retained for the purpose of determining that the quality and workmanship of the delivered items are comparable to the sample.

If any proposer who submitted a proposal has an objection to the award of the contract to the selected proposer, the objecting proposer shall furnish that protest, in writing, to the executive director of procurement or designee within ten 10 business days of the notification of nonaward.

Proposers who violate the code of silence may be deemed nonresponsive, and their proposal may be rejected for cause. Failure to follow instructions regarding proposal forms may result in disqualification. Failure to comply with debarment and suspension requirements will cause your bid to be disqualified and declared nonresponsive. Violation of the provision regarding contact with district employees (except through the executive director of procurement) shall be considered grounds for disqualification.

Bidders must specify delivery date. Delivery shall be F. O. B. McKenzie County Road Dept. , Watford City, North Dakota.

McKenzie County Road Dept. shall withhold five 5 percent of the bidders net bid for at least thirty days after the delivery of said bid item to ensure compliance with all agreed upon specifications.

Upfitters warranty workmanship must be one year 12 months for all installations. Monroe equipment one year from all installations. Crysteel warranty includes 5 years total: 3 years 36 months at 100% coverage, last 2 years 24 months at 50% coverage. Crysteel paint warranty 5 year. Force America one year 12 months from delivery date.

Basis of the award shall be dependent on the most responsible bid submitted. Consideration will be given to purchase price, repurchase price, delivery date, equipment service guarantees, parts and service availability, parts and service facilities location, analyses and comparison of equipment specification details.

No bid will be considered unless accompanied by a bid bond, in the amount of not less than five 5 percent of the total amount of the bid. Bids will not be considered that do not include a copy of the manufacturers literature/specification material.

Failure not to do so may result in nonacceptance of the bid.

The agreements officer or contracting officer will negotiate directly with the company on the terms and conditions of the award, including payment terms, and will execute the award instrument on behalf of the government.

Proposals will be evaluated based on prototype definition and quantity, mission effectiveness, nontraditional participation, cost share, and defense utility.

Companies must have a Unique Entity ID (UEI) and must register in the System for Award Management (SAM) prior to receiving an award. Companies must also register in the prescribed government invoicing system. The company must be determined to be responsible by the Agreements/Contracting Officer and must not be suspended or debarred from award by the Federal government.

The penalty for making false statements in proposals is prescribed in 18 ****.

Failure to fully and accurately disclose all intellectual property and associated restrictions may result in the submission being deemed noncompliant.
