Unless otherwise specified, the contractor shall unconditionally guarantee the materials and workmanship on all equipment for a period of one year from date of acceptance.

The contract will be awarded to the lowest responsive and responsible bidder in accordance with the method of award contained elsewhere in these documents, provided the bid price is reasonable and it is in the best interest of the district to accept it.

If requested in writing by the director, the bidder must present, within forty-eight (48) hours, satisfactory evidence of the ability to perform and possession of the necessary facilities, monetary resources and adequate insurance to comply with the terms of these documents and specifications.

Failure to deliver goods and/or services within the time stipulated on this bid, unless extended in writing by the director, or failure to perform any other provisions of the contract, or failure to make progress as to endanger performance of the contract in accordance with its terms, shall constitute default.

If requested by the director, the bidder will be required to submit samples and, if necessary, demonstrate the products being bid. Failure to furnish the samples or demonstrate the products within five (5) business days after request shall be deemed sufficient grounds for disqualification.
