The time of completion shall consist of 10 working days. The contractor shall begin work by the date identified in writing in the notice to proceed by the City of Grass Valley. The first working day will not be determined until the contractor has the new sludge heater/boiler apparatus on hand. The boiler can be offline for 7-10 days between October 15th and March 31st, and for a maximum of 5 days between April 1st and October 14th.

The City agrees to pay the contractor the sum specified in the contract, subject to additions and deductions as provided in the contract documents. Prompt payment provisions in accordance with section **** of the Public Contract Code apply. If the City fails to make a progress payment within 30 days after receipt of an undisputed and properly submitted payment request, the City shall pay interest to the contractor equivalent to **** per month (10% per annum).

Should any failure of the work occur within a period of one year from the acceptance of the project by the Grass Valley City Council due to faulty materials, poor workmanship, or defective equipment, the contractor shall promptly make the needed repairs at his or her expense. Security for this warranty shall be in the form of the performance bond, which shall remain in effect for a period of one year after acceptance of the project.

The contract will be awarded in accordance with California Public Contract Code section **** and other applicable law to the responsible bidder submitting a responsive bid with the lowest total bid price for the base bid without consideration of the bid price for any additive or deductive items.

The contractor shall possess a valid California Class A contractors license, or a combination of the following classes: C10 Electrical Contractor and C36 Plumbing Contractor, and all other classes required by the categories and types of work included in the contract at the time of the bid award. All licenses shall remain in effect throughout the term of the contract. Additionally, contractors and subcontractors must be registered and qualified to perform public work pursuant to Labor Code section ****.

The contractor shall pay to the City of Grass Valley the sum of $1,000 per day, as liquidated damages, for each and every calendar day delay in finishing the work in excess of the working days prescribed above. The City may deduct this sum from any payment due to the contractor. Contractors and subcontractors shall forfeit **** for each worker employed in violation of the 8-hour day and 40-hour week provisions.

Representatives of the bidder have visited the project site and have familiarized themselves with the conditions under which the project work is to be performed. Bidders seeking to conduct any additional examination or other inquiry at the project site must request site access from the City at least two working days in advance.

Any protest of the proposed project award must be submitted in writing to the City no later than 5:00 pm on the third business day following the date of the bid opening.

The engineers estimate for this project is $500,****.

The bid notice states contractor represents that he or she is fully qualified to perform the requested services and is willing to accept responsibility for performing such services in accordance with the terms and conditions set forth in this agreement and as listed in attachment a terms and conditions for contractor agreements.

A selection committee will perform an indepth analysis of all proposals, carefully evaluating each one with the following criteria: project understanding and approach 30, qualifications and technical skills of assigned staff 30, experience and capabilities of firm 25, familiarity with city, county and state procedures 10, completeness and overall quality of proposal 5, total 100.

The successful consultant shall be responsible for compliance with all applicable california state prevailing wage laws.
