Proposals must be submitted by July 23, 2026, 3:00 PM PDT.

The county seeks the optimal combination of quality, price, and various qualitative elements of the required services that will provide the county with the greatest or best value for its money.

Proposers must be interested and qualified, with specific qualifications for laboratory personnel including a doctoral degree in a biological or chemical discipline and at least three years of full-time laboratory experience in forensic toxicology, or equivalent experience. Proposers must also be compliant with California Code of Regulations, possess appropriate laboratory licenses, and a current controlled substances registration certificate. Accreditation by the American Board of Forensic Toxicology is required.

Making a false certification may subject the proposer to civil penalties, termination of an existing contract, and ineligibility to bid on a contract for a period of three years.

The county reserves the right to inspect the proposer facilities and transportation vehicles, if applicable, periodically on scheduled or nonscheduled visits, as desired.

Protests must be submitted in writing within ten 10 calendar days of the issuance date of the Notice of Intent to Award (NOIA).

Proposers will be disqualified if they fail to register with the ePro system prior to the submission deadline, submit late or incomplete proposals, or fail to provide required information for background checks or criminal/civil proceedings.

Delivery shall be FOB County's place of delivery with immediate delivery based upon availability, but no later than ninety (90) days after issuance of County's purchase order.

San Bernardino County payment terms are net 60 days after invoice and acceptance of the product.

Contractor agrees that the equipment or supplies to be furnished shall be covered by the most favorable commercial warranties the contractor gives to any customer for the same or substantially similar equipment or supplies.

Award will be made by Sheriff to the responsive, responsible bidder providing the best value.

The county reserves the right to perform a pre-award survey of the bidder to determine capability to perform, including but not limited to facilities, financial responsibility, materials/supplies, and past performance.

In the event of termination for default, the defaulting contractor shall be liable for the difference between the prices set forth in the terminated order and the actual cost thereof to the county.

All items or services are subject to final inspection and acceptance at designation by the county. Such final inspection shall be made within a reasonable time after delivery.

Samples of items, when required, must be furnished free of expense to the county, and if not destroyed by tests will, upon request, be returned at the bidders expense.

Bidder may appeal the recommended award or denial of award protest, provided the protest is submitted in writing within ten (10) calendar days of the issuance date of a notice of intent to award.

If bidder is unable to certify any of the facts set forth in sections c. 1, c. 2, or c. 3, it certifies that it has listed on a separate sheets attached to this Representations and Certifications each fact that it cannot certify and the reason it cannot do so. The county reserves the right to disqualify bidder based upon information disclosed.
