Award will be made by the department of public health to the responsive, responsible bidder providing the best value.

The county reserves the right to perform a preaward survey of the bidder to determine capability to perform, including but not limited to facilities, financial responsibility, materials/supplies, and past performance.

Samples of items, when required, must be furnished free of expense to the county, and if not destroyed by tests will, upon request, be returned at the bidders expense.

A protest can only be brought on the following grounds: failure of the county to follow the selection procedures and adhere to requirements specified in the invitation to bid or any addenda or amendments; violation of conflict of interest as provided by california government code section **** et seq. ; violation of state or federal law.

The county reserves the right to disqualify bidder based upon information disclosed in the representations and certifications section, or if the proposer is determined to be a target of economic sanctions or is conducting prohibited transactions with sanctioned individuals or entities.
