Sealed bids or bids submitted via email are due by 2:00 PM on Thursday, May 29th, 2025. Additional forms disclosing first-tier subcontractors are due by 4:00 PM. Bidders must be prequalified in accordance with Oregon law and licensed with the Oregon Construction Contractors Board. The bid must contain a statement that the bidder will comply with the provisions of ORS **** prevailing wage rates. Bids must be accompanied by a certified check, cashier's check, irrevocable letter of credit or bid bond in an amount equal to not less than ten percent (10%) of the total amount of the bid. Bidders must list their construction contractors board or state landscape contractors board license number on the bid form. The proposed work generally consists of furnishing all labor, equipment, materials and supervision including public notification, traffic control, flagging and
pavement marking for the construction of approximately 48,822 square yards of asphalt emulsion slurry seal. Bids will be evaluated as unit price pursuant to OAR 13704903802b. The work must meet the highest industry standards. Failure to meet standards may result in payment reductions, additional work at bidder's expense, or contract termination. Bidders must disclose information about first-tier subcontractors if the subcontract value is equal to or greater than 1/5 of the project bid or $15,000, whichever is greater, or $350,000 regardless of the percentage. Bidders must have an employee drug and alcohol testing program in place. The successful bidder must file a $30,000 public works bond with the Construction Contractors Board prior to beginning work. Bidders with 50 or more employees and for contracts over $500,000, are required to possess a certificate issued by the Department of Administrative Services for completion of pay equity training. The city may reject any bid not in compliance with all public bidding procedures and requirements. A bidder may protest or request a change in bid documents by filing a written protest with the city not less than ten (10) calendar days prior to the bid submission deadline. The city reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the city that such bidder is properly qualified to carry out the obligations of the contract. Conditional bids will not be accepted. Within forty-five (45) calendar days after the bid opening, the city will accept one of the bids or reject all of the bids received. A bidder may submit a formal written protest to the city's notice of intent to award the contract within seven (7) calendar days of the date of the city's notice of intent. The bidder whose bid is accepted will be required to execute the contract and furnish the required bonds within ten (10) days after notice that the contract has been awarded. If the successful bidder fails to execute the contract and furnish the required bonds, the bid bond will be retained by the city as liquidated damages. The contract shall be in effect from the time the contract is signed until the project is completed. The contractor must be capable of commencing construction within ten (10) calendar days after the execution of the contract and receipt of the city's notification to proceed and shall complete the same within the time specified in the bid. All bids will be binding until the later of the day the contract is executed or sixty (60) calendar days after the date of bid opening. Bid bonds will be returned to unsuccessful bidders not later than the date on which the bids are no longer binding. Materials containing asbestos may be present in underground pipe systems. All appropriate federal, state, county and municipal rules, regulations and guidelines must be followed when working with asbestos containing material.
