Payments are due to vendor by HCDE and any cooperative purchasing member within forty-five (45) days after the later of: 1) the date HCDE or the member receives the products and services; 2) the date the performance of the service is completed; or 3) the date HCDE or the member receives an invoice for the products or service. For members whose governing bodies meet more than once a month, payments are due within thirty (30) days.
All products and/or services provided by the vendor must be warranted to be free from defects in material, workmanship, and design for a period of one (1) year upon the later of HCDE's or the member's acceptance of the product and/or service or payment of the applicable invoice.
Awards will be made to responsible vendors whose proposals are determined to be the best value to HCDE and its cooperative purchasing members. Evaluation criteria include price, vendor reputation, quality of goods/services, impact on compliance with laws, financial capability, past relationship with HCDE/members, and marketing plan.
To qualify for evaluation, a proposal must be submitted on time and materially satisfy all mandatory requirements identified in the RFP. A responsible vendor has adequate financial resources, can comply with delivery requirements, and is a qualified and established firm regularly engaged in the type of business.
If a vendor fails to fulfill contract terms, HCDE or the member may insist on honoring quoted prices, have the vendor pay the difference between their price and the next acceptable proposal, or the actual market price, or recommend to the board that the vendor not be considered for future proposals.
Complaints/appeals must be received by the close of business on or before the 15th HCDE business day after award of the contract.
