The construction covered by the contract documents shall be substantially completed within 45 consecutive calendar days from the date specified in the notice to proceed issued by the City of Lubbock to the successful bidder. For asphalt patching, the repairs shall be completed in 50 consecutive calendar days.

All payments due to the contractor shall be made in accordance with the provisions of the general conditions of the contract documents. Partial payments will be processed on or before the tenth day of each month.

All equipment and materials incorporated in the project and all construction shall be guaranteed against defective materials and workmanship. Prior to final acceptance, the contractor shall furnish a written general guarantee that they shall remedy any defects in the work and pay for any damages resulting from such defects when they appear within one year from the date of final acceptance of the work, at no cost to the City of Lubbock.

All bids are evaluated for compliance with specifications before the bid price is considered. Response to specifications is primary in determining the best low bid. The city shall award the bid based on the total bid for bid item 11 plus the sum of any alternate bids or options the city may select.

The bidder may be required before the award of any contract to show to the complete satisfaction of the City of Lubbock that it has the necessary facilities, ability, and financial resources to provide the service specified therein in a satisfactory manner. The bidder may also be required to give a past history and references in order to satisfy the City of Lubbock about the bidder's qualifications.

The contractor shall pay to the owner $1,**** per day for each calendar day after the 50-day completion period for asphalt patching until completion as liquidated damages. No credit will be given for bad weather days or other delays. The contractor shall forfeit $60 for each laborer, workman, or mechanic employed for each calendar day, or portion thereof, such laborer, workman, or mechanic is paid less than the wages assigned to his particular classification.

It shall be each bidder's sole responsibility to inspect the site of the work and to inform bidder regarding all local conditions under which the work is to be done.

All protests regarding the ITB process must be submitted in writing to the City Director of Purchasing and Contract Management within 5 working days after the protesting party knows of the occurrence of the action which is protested.

The city uses the competitive sealed proposals procurement method. The selection criteria used to evaluate each proposal includes the following: 60 points for price, 30 points for contractor qualifications, and 10 points for construction time.

The contractor shall forfeit as a penalty to the city of Lubbock on whose behalf this contract is made, sixty dollars for each laborer, workman, or mechanic employed for each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than the wages assigned to his particular classification as set forth in the schedule of general prevailing rate of per diem wages included in these contract documents.

It shall be each offerors sole responsibility to inspect the site of the work and to inform offeror regarding all local conditions under which the work is to be done.

All protests regarding the rfp process must be submitted in writing to the city director of purchasing and contract management within 5 working days after the protesting party knows of the occurrence of the action which is protested relating to advertising of notices deadlines, proposal opening and all other related procedures under the local government code, as well as any protest relating to alleged improprieties with the rfp process.

The estimated budget for the construction phase of this project is $180,****.

The sealed proposals and electronic submittals shall be received until April 15, 2026, prior to 3:00 p. m. Please allow time to upload required documentation; 24 hours in advance is recommended.

The contractor shall receive compensation for services provided on a monthly basis. Upon the end of each month, during the contract period, the contractor shall submit an invoice to the business development director for the monthly cost of maintenance. Any extra work shall be shown on the same monthly invoice and identified as extra work.

Selection shall be based on the responsible offerors whose proposal is determined to be the most advantageous to the City of Lubbock considering the relative importance of evaluation factors included in this RFP. The following criteria will be used to evaluate and rank submittals: Price (30 points), Qualifications/Experience (50 points), and Project Approach (20 points).

Offerors are required to describe a minimum of three most recent projects and provide references. The proposal should also include a description of the methodology to be used, identification of assigned positions and their roles, suggested project schedule, specific expertise, a brochure of past work, a list of principals and other professionals to be used, and the organizational structure of employees assigned to the project.

If the contractor fails to remove material within 48 hours after written notification from the agent, the city shall remove the material and charge the contractor for the expense, which will be deducted from the contractor's payment. If such conditions continue, the contract may be terminated due to breach of contract. Any penalties, fines, or citations for watering ordinance violations shall be paid by the contractor.

A pre-proposal meeting will be held on April 1, 2026, at 10:00 a. m. via teleconference. While the meeting is not mandatory, it is the proposer's responsibility to attend.

All protests regarding the RFP process must be submitted in writing to the City Director of Purchasing and Contract Management within 5 working days after the protesting party knows of the occurrence of the action which is protested.

The contractor must be able to start work on the vehicle within 14 days if not, citibus will move to the next awarded contractor.

The contractor agrees the service furnished to be of the highest quality, complying with specifications, and free from all defects in materials and workmanship for a period of one 1 year from the date of acceptance.

The following criteria will be used to evaluate and rank submittals: cost, references, qualifications and experience, quality of materials and workmanship.

The proposer must have a complete body shop meeting the following minimum requirements: paint booth, frame and straightening machines with qualified operator onsite or under contract.

If the contractor does not meet the due date, a 300 per day nonuseable vehicle charge will be assessed and subtracted from the final repair invoice.

A preproposal meeting will be held on prepro date, march 18th, 2026, at 10: 00 a. m. via teleconference.
