The construction covered by the contract documents shall be substantially completed within 45 consecutive calendar days from the date specified in the notice to proceed issued by the City of Lubbock to the successful bidder. For asphalt patching, the repairs shall be completed in 50 consecutive calendar days.
All payments due to the contractor shall be made in accordance with the provisions of the general conditions of the contract documents. Partial payments will be processed on or before the tenth day of each month.
All equipment and materials incorporated in the project and all construction shall be guaranteed against defective materials and workmanship. Prior to final acceptance, the contractor shall furnish a written general guarantee that they shall remedy any defects in the work and pay for any damages resulting from such defects when they appear within one year from the date of final acceptance of the work, at no cost to the City of Lubbock.
All bids are evaluated for compliance with specifications before the bid price is considered. Response to specifications is primary in determining the best low bid. The city shall award the bid based on the total bid for bid item 11 plus the sum of any alternate bids or options the city may select.
The bidder may be required before the award of any contract to show to the complete satisfaction of the City of Lubbock that it has the necessary facilities, ability, and financial resources to provide the service specified therein in a satisfactory manner. The bidder may also be required to give a past history and references in order to satisfy the City of Lubbock about the bidder's qualifications.
The contractor shall pay to the owner $1,**** per day for each calendar day after the 50-day completion period for asphalt patching until completion as liquidated damages. No credit will be given for bad weather days or other delays. The contractor shall forfeit $60 for each laborer, workman, or mechanic employed for each calendar day, or portion thereof, such laborer, workman, or mechanic is paid less than the wages assigned to his particular classification.
It shall be each bidder's sole responsibility to inspect the site of the work and to inform bidder regarding all local conditions under which the work is to be done.
All protests regarding the ITB process must be submitted in writing to the City Director of Purchasing and Contract Management within 5 working days after the protesting party knows of the occurrence of the action which is protested.
