Offerors must submit written evidence of their qualifications, including maintaining a permanent place of business, adequate plant and equipment, organization, manpower, technical knowledge, financial status, no pending claims, and at least five years of experience designing and manufacturing similar transformers. Each offeror must submit written evidence of their qualifications to the city of lubbock water utilities department.

All protests regarding the RFP process must be submitted in writing within 5 working days after the protesting party knows of the occurrence of the action which is protested. Vendor warrants all equipment against defects for a period of twelve months from and after final acceptance. Awards will be based primarily on lowest bid price, maintenance and support plan costs over five years, delivery lead times, and details of maintenance support plans. Failure to enter into contract or honor the purchase order after bids have been accepted may result in removal from the city's bidders list for twelve months and pursuit of remedies available at law or in equity. once bids have been accepted by the city and closing has occurred, failure to enter into contract or honor the purchase order will be cause for removal of suppliers name from the city of fort collins bidders list for a period of twelve months from the date of the opening. the city may also pursue any remedies available at law or in equity.
