The department shall make payment within 30 days of receipt of a payment request which is approved as payable by the department, on this contract as is indicated below, by one of the following methods: 1. lump sum basis this section is not applicable to this contract.

The contractor shall warrant that the work, for a period of one year from the date of final acceptance by the department, shall remain free from all defects in workmanship and material and that it will comply with therequirements of this contract governing the work.

The lowest responsive, responsible bidder will be eligible for award of a subsequent contract.

To be considered a responsible and responsive bidder, all the information requested on the proposal form attachment a must be completed and received by the iowa department of natural resources by 3: 00pm, september 10, 2026.

For each calendar day that any work shall remain uncompleted after the end of the contract period, number of working days allowed, or any extension granted, the amount per calendar day specified in the proposal form will be assessed, not as a penalty, but as predetermined and agreed liquidated damages.

It is the contractors responsibility to visit the project site prior to bidding to determine current site conditions.

If the contractor fails to complete the work within the contract periods or any extension thereof, upon written notice to the contractor and surety, said contract shall be in default.
