Payment will be made in accordance with the Texas Prompt Payment Act, typically within 30 days after receipt of a properly prepared invoice. Payment normally will be made to contractor within thirty (30) days after receipt of a properly prepared invoice.

The award will be based on the best value standard, considering past performance (30%), proposed plan (40%), and cost reasonableness (30%). TDA shall not be obligated to accept the lowest priced solicitation response but shall make an award to respondent that provides the best value to the state of Texas.

Respondents must have a current Texas Identification Number, be current on business filings and taxes, and be registered with the Secretary of State if a foreign entity. Respondent must: a. have a current Texas identification number issued by CPA.

Failure to sign the document will disqualify the response. False statements may result in disqualification, contract cancellation, or debarment. Failure to sign will disqualify response. TDA may pursue and enforce any available remedies against respondent for making false statements, including disqualifying respondents response, immediately cancelling any contract.

Responses with exceptions, reservations, or limitations to terms and conditions will be disqualified. Late responses will be disqualified. Proposals that contain exceptions to the specifications, deliverables, or standard terms and conditions of this solicitation will be disqualified.

The estimated response due date is August 20, 2026, at 3:00 PM CT.

The award will be made to the respondent that provides the best value to the state of Texas, considering factors such as past performance, qualifications, experience, proposed plan, and reasonableness of cost.

Respondents must have a current Texas Identification Number, be current in business filings and tax payments, and be registered with the Texas Secretary of State if incorporated outside Texas. They must also demonstrate necessary qualifications, experience, and past performance.

Failure to sign the document, making false statements, not submitting required exhibits, late responses, or failing to comply with security guidelines may result in disqualification.
