Contractor makes the following warranties to the board: it will have good title to all goods supplied, said goods will be free of liens and encumbrances, all goods supplied will be of merchantable quality, and all goods supplied will be fit for the particular use intended, free from defects, and in full conformity with the specifications. These warranties shall survive acceptance of the goods.
Contracts will be awarded to the lowest responsible, responsive bidder, as determined by the board in its sole judgment, considering conformity with specifications, terms of delivery, quality and serviceability, and such other factors as the board deems necessary and appropriate in the best interest of the school district.
Proposals must be made in accordance with the instructions, submitted on forms of proposal marked exhibits a, b, c, d, and e, and signed by legally authorized persons. Oral, telephonic, telegraphic, electronic, or facsimile transmitted bids will not be accepted. Bidders must familiarize themselves with the conditions pertinent to the fulfillment of the work required.
The board reserves the right to terminate the contract for just cause upon ten (10) days written notice to the contractor without any penalties. Just cause may include failure to pay suppliers, disregard of laws, failure to follow bid specifications, or failure to maintain the level of service required.
