This contract is for the design and build of approximately 6. 3 miles of mountain bike trails at Hickory Hills Preserve. The project includes various trail types (beginner, intermediate, advanced) and features such as berms, rollers, tabletops, and drops. Estimated construction costs range from $250,000 to $350,000. The contractor will be responsible for all labor, materials, and equipment. The contract period is to be determined, with an intended completion date to be specified. Payment will be based on a guaranteed maximum price. The contractor must comply with all local, state, and federal laws and regulations. Maintenance and guarantee obligations are for one year after final payment. Dispute resolution will involve mediation and arbitration.
The contract working time shall be days with an intended completion date of . The duration of such extension shall be determined by the city engineer.
The city shall pay to the contractor and the contractor guarantees that the maximum amount payable by city as full compensation for services under this agreement, including preliminary stage design and construction, will not exceed to be determined the guaranteed maximum price, subject to increases or decreases for changes in the scope of work properly authorized pursuant to the terms of this agreement.
For one year after the date of final payment, the contractor shall maintain and repair the work. Any work which is found to be defective shall promptly and without cost to the city and in accordance with the citys written instructions, be corrected or replaced with nondefective work.
The contractor specifically represents and agrees that its officers, employees, agents and consultants have and shall possess the experience, knowledge, and competence necessary to qualify them individually for the particular duties they perform hereunder.
If the contractor does not promptly repair or replace the work pursuant to the citys directions, the city may itself correct the defective work or may have the defective work corrected by another contractor. The contractor shall pay all of the citys costs and expenses, including city employee costs associated with the repair or replacement of the defective work.
If contractor wishes to make a claim for an increase in the guaranteed maximum price, an increase in its fee, or an extension in the completion dates, it shall give city written notice thereof within number of days days after the occurrence of the event giving rise to such a claim.
The contractor certifies that it does not and will not, during the performance of this contract, employ illegal alien workers or otherwise violate the provisions of the federal immigration reform and control act of ****, as amended.
