The delivery and/or completion is to be made within as required days from the time of notification by the City. The mailing must be completed by Thursday, May 1, 2026.

The bidder who is awarded the contract guarantees to the City of Worcester all equipment, materials and/or workmanship for a period of one year after final inspection and acceptance and shall replace promptly any defective equipment, materials and/or workmanship required without additional cost to the City.

The procurement officer shall award the contract to the lowest responsible and responsive bidder.

The bidder must certify that no official or employee of the City of Worcester, Massachusetts is pecuniarily interested in this proposal or in the contract which the bidder offers to execute or in expected profits to arise therefrom, unless there has been compliance with provisions of G. L. c. 43 sec. 27, and that this bid is made in good faith without fraud or collusion or connection with any other person submitting a proposal.

If any bid is withdrawn after the time and date specified, the bidder shall forfeit deposit on bid as liquidated damages. If the successful bidder fails to make delivery or complete contract within time specified, the city reserves the right to make the purchase on such orders at the open market and charge any excess over contract price to the account of the successful bidder, who shall pay the same.

Samples of the product to be delivered may be taken by a representative of the city, either prior to delivery or while it is being delivered in the storage facilities at destination, or will be taken from the storage facilities to which the product has been delivered as determined from time to time by the purchasing agent. Bidder agrees to furnish the necessary manual labor, without additional cost required to assemble the physical samples, which is to be performed under the direction of the city representative.

Any prospective bidder requesting a change in or interpretation of existing specifications of terms and conditions must do so within five 5 days Saturdays, Sundays and holidays excluded before scheduled bid opening date.

The bid notice states that proposals must be delivered no later than Wednesday, April 22, 2026, at 10:00 AM local time. Late submissions will be rejected, regardless of circumstances.

The vendor shall provide to the city of Worcester a warranty and a commitment which clearly states that all equipment and services proposed and supplied by the vendor, and/or its subcontractors, performs as expected and promised by the vendor.

The city will select the proposer, which in the city's opinion, has made the proposal best suited to the needs and goals of the city and its operations and deemed to be in compliance with the terms of this RFP. The purchasing agent will identify the most advantageous proposal based upon the rankings of the selection committee and an evaluation of the cost proposals received.

The vendor must provide descriptions of the staff, including number of staff and qualifications of each, available to work with city employees. Staff must include coverage with a minimum of either an RN or a Master's level social worker. Counselors must be available to counsel employees 24 hours a day, 365 days per year. The proposal must also include a sworn statement that it has maintained all accreditations and licenses required by the Commonwealth of Massachusetts.

In the case of default, the surety shall be forfeited to the city as liquidated damages. If the proposer shall fail to contract as set forth in these requirements and to give a bond in the aforementioned amount, within ten 10 days, the city may by option determine that the proposer has abandoned the contract and thereupon the proposal and acceptance shall be null and void and the proposal security accompanying this proposal shall become the property of the city as liquidated damages. Any proposal withdrawn after time and date specified, the proposer shall forfeit deposit on proposal as liquidated damages.

The work must be completed no later than June 30, 2026.

Payment shall be made by the City in accordance with general laws chapter 30, section 39g **** ed. , as amended.

The contractor guarantees the work under this agreement and the materials furnished by him for use in connection therewith to be free from defects or flaws for one year after the completion of the agreement.

The general contract will be awarded to the lowest responsible and eligible general bidder complying with the conditions and requirements provided in these instructions, the bid forms and the other bid documents.

The bidder is requested to state below what work of a similar character to that included in the proposed contract he/she has done and to give references that will enable the owner to judge his/her experience, skill, business standing and overall responsibility.

The contract documents contain provisions regarding penalties for failure to comply with various requirements, including those related to labor, materials, and project completion.

A walkthrough of the site will be available on April 15, 2026, at 09:00 am EST. Vendors must RSVP for the walkthrough by emailing their intention to attend.

The contract documents refer to samples as physical examples that illustrate materials, equipment or workmanship and establish standards by which the work will be judged.

All questions and requests for clarifications or interpretations of the meaning of the contract documents shall be in writing, addressed to the purchasing department, city of Worcester, and to be given consideration must be received at least five (5) days prior to the date fixed for opening of bids.

Failure to contract and provide a bond within ten days of notification may result in the bidder being deemed to have abandoned the contract, with the bid security becoming the property of the city as liquidated damages.
