Offerors must submit information related to qualifications, experience, and reliability. The offeror is advised to submit any information which documents successful and reliable experience in past performances, especially those performances related to the requirements of this rfp.

Proposals may be rejected if not properly signed, if the offeror is in arrears to the city, or if the certification of prohibited entity status is false. Proposals not properly signed may be rejected.

Proposals are due June 25, 2026, at 4 PM MDT. Proposals received after the deadline will not be reviewed.

Invoices are due and payable within 60 days of receipt. If the city fails to make any payment due to the consultant for services and expenses within 60 days after receipt of the consultants invoice, then the city will be considered in breach of the payment terms of this agreement, and the compounded amount due the consultant will be increased at the rate of 1. 0 per month from said sixtieth day.

Selection is predominantly based on qualifications and best value, with criteria including consultant qualifications for and understanding of the project (50%), completeness of proposal and team availability to meet the schedule (40%), and fee (10%). Cost will be a factor in evaluation, but selection is predominantly based on qualifications and best value.

Offerors must submit information related to at least three previous and current service contracts similar to the RFP requirements. The qualifications of the personnel proposed by the offeror to perform the requirements of this rfp, whether from the offerors organization or from a proposed subconsultant, will be subjectively evaluated.

Proposals not properly signed may be rejected. Failure to submit all requested information could be grounds to reject the proposal. Submitting a false certification of prohibited entity status may result in contract termination and debarment. No proposal shall be accepted from, or no contract or purchase order shall be awarded to any person, firm or corporation that is in arrears upon any obligations to the city of box elder or that otherwise may be deemed irresponsible or unreliable by the city of box elder.

All work specified in the contract documents must be completed by December 11, 2026.

Method of payment under this contract will be made on a monthly basis until the work is complete. 10% of the final payment amount will be retained until all lien waivers have been filed and the owner is satisfied all claims for material and labor have been satisfied.

Contractor agrees to warrantee the work against defects in material and workmanship for a period of two 2 years after the date of final payment.

The owner intends to award the project to the lowest responsible, qualified bidder.

The owner may make such investigations as is deemed necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish to the owner all such information and date for this purpose as the owner may request. The owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the owner the bidder is properly qualified to carry out the obligation of the agreement and to complete the work contemplated therein.

Bidder accepts the provisions of the agreement of liquidated damages in the amount of two hundred and fifty dollars $250 per calendar day for failure to complete on time.

Bidder has visited the site and become familiar with and is satisfied as to the general, local, and site conditions that may affect cost, progress, and performance of the work.

The bidder certifies that they are not a prohibited entity as defined by SDCL **** false certification may be grounds for the city to reject the bid or response submitted by the bidder and terminate any contract awarded.
