TMD recommends electronic funds transfer (EFT) for payments. Payments will be processed after TMD's receipt, testing, and acceptance of commodities and services. Texas Government Code Chapter ****, the Prompt Payment Act, will govern payment and interest on overdue payments.

A minimum one-year warranty on all workmanship and standard manufacturer's warranty on products is required. The new roof system must be issued with a 15-year roof system warranty.

TMD will evaluate responses in accordance with the best value standard, with the award typically going to the responsible respondent whose response is the lowest price meeting specifications.

The contractor's proposed project manager must have a minimum of five years of direct experience managing roofing projects on federal government installations or commercial buildings of similar scope. The contractor must also provide proof of current OSHA certifications for the onsite team and demonstrate a history of successfully completing similar projects with at least three verifiable references.

If contractor fails to comply with the terms of the contract, TMD may withhold contractor payment. If noncompliance results in TMD purchasing goods or services from another entity to remedy the noncompliance, TMD will deduct those costs from contractor payment.

Two mandatory site visits are scheduled for June 10, 2026, and June 12, 2026, at 10:00 AM. Failure to attend a minimum of one site visit will result in disqualification.

The last day to submit written questions for clarification to TMD is **** at 2:00 PM.

City of Grand Junction payment terms shall be net 30 days. Prompt payment discount of percent of the net dollar will be offered to the owner if the invoice is paid within days after the receipt of the invoice.

The contractor warrants to the owner that all materials and equipment furnished under this contract will be new unless otherwise specified, and that all work will be of good quality, free from faults and defects and in conformance with the contract documents. A 30-year NDL warranty by the manufacturer is required for the roof system.

The owner reserves the right to make the award on the basis of the offer deemed most favorable, to waive any formalities or technicalities and to reject any or all offers. The owner will conduct investigations to assist in the evaluation of any bid and to establish the responsibility, qualifications, and financial ability of the offeror.

Prospective bidders must be qualified and interested contractors. Offerors may be required to submit satisfactory evidence that they are responsible, have a practical knowledge of the project bid upon and that has the necessary financial and other resources to complete the proposed work.

If the contractor does not achieve final completion by the required date, the contractor shall pay liquidated damages to the city for each day that final completion is late, in the daily amount of ****.

Prospective bidders are encouraged to attend a nonmandatory prebid site visit on Friday, June 12, 2026, at 10:00 AM. Meeting location shall be in the Persigo Training Room, located at **** River Road, Grand Junction CO ****.

A bid will not be accepted from, nor shall a contract be awarded to, any person, contractor, or corporation that is in arrears to the owner, upon debt or contract, or that has defaulted, as surety or otherwise, upon any obligation to the owner, or that is deemed irresponsible or unreliable. Evidence of collusion among offerors can also lead to disqualification.

Substantial completion is required by January 8, 2027, and full completion by February 5, 2027. work on the project must be commenced within ten 10 calendar days after the notice to proceed has been issued and shall be substantially completed by january 8, 2027, and fully completed by february 5, 2027.

The town will accept payment requests for work and inventory in place. It will withhold a 5% retainage, which will be reimbursed when the town accepts the work.

The solar provider's standard system warranty should cover modules (10-year power output, 10-year workmanship), inverters (10-year limited warranty), racking (10-year limited warranty), and workmanship (1-year limited warranty).

The award will be made to the respondent with the overall best value proposal, which will meet project site design guidelines and provide service acceptable to the town. Points are awarded for project approach, understanding and management (35 points), implementation schedule (30 points), company qualifications/project experience (20 points), and project team experience (15 points).

Respondents shall have demonstrated experience designing, planning, scheduling, permitting, and constructing complete solar systems, with knowledge of local utilities, project financial analysis, rebate support, system monitoring, and maintenance, and established onsite safety standards. A Statement of Qualifications (SOQ) is required.

If, through any cause, the contractor fails to fulfill obligations in a timely and proper manner, the town has the right to terminate the contract. The contractor shall not be relieved of liability for damages sustained by the town due to any breach.
