The contract begins on 11/06/2026 and ends on 11/05/2032.

Payments will be made electronically via automatic deposit. Retainage is 10% of each invoice, with 90% released quarterly if performance is satisfactory. The balance is released upon satisfactory completion of all services.

Quotes will be evaluated based on technical criteria (personnel, firm experience, ability to complete scope of work) and price evaluation. The state reserves the right to award based on the initial submission or conduct negotiations/BAFOs.

Bidders must have the necessary facilities for performing the contract and may be bypassed if they have a history of performance problems. The state may inspect bidders' facilities and check references.

Liquidated damages are specified for various service level failures, such as audit failure rates, data retention issues, security breaches, and delays in repairs or updates. Penalties can range from $500 to $25,000 per incident or day.

A bidder with a history of performance problems may be bypassed. Failure to comply with security requirements or data handling policies can lead to contract termination.

Delivery shall be made between the hours of 8 a. m. and 5 p. m. Central time, Monday through Friday, excluding state holidays, unless prior approval for another delivery time has been granted by Tceq.

In accordance with the Texas Prompt Payment Act, Tceq will pay an acceptable invoice within 30 days of receipt. Tceq may dispute an invoice by sending a notice in writing to the contractor within 21 days of receipt.

Contractor warrants that all goods, services, and property provided conform to the contract and are merchantable, fit for purpose, of best quality, and free from deficiencies. Warranties are effective upon final payment and for 24 months thereafter.

Contractor shall provide competent, suitably qualified personnel. Contractor will use the U. S. Department of Homeland Security's e-Verify system to determine eligibility of personnel.

In the event of early termination by the contractor, contractor shall provide at least 180 days written notice. Early termination may result in calling of the performance bond.

Tceq may make a scheduled or unscheduled visit to any location where the work is being performed.

Contractor must provide Tceq with a written objection to any notice of interpretation no later than five (5) business days from the effective date of the notice.

If contractor is debarred by the state of Texas or is subject to suspension, debarment, exclusion, disqualification, or similar ineligibility determined by any federal, state or local government entity, Tceq may terminate this contract for cause.
