Disqualification may occur due to evidence of collusion among bidders, lack of competency, lack of responsibility, or uncompleted work under other contracts. any one or more of the following causes may be considered for the disqualification of a bidder as nonresponsible and the rejection of the bid:

Delivery and/or completion will be made within twelve 12 days from date of notification if no date is indicated. Should the successful bidder fail to make delivery or complete contract within time specified, the city reserves the right to make the purchase on such orders at the open market and charge any excess over contract price to the account of the successful bidder, who shall pay the same.

Prompt pay discounts will be considered when determining the low bid except when discounts are for a period of less than 30 days. Terms, prompt pay discount 30 days, net 45 days.

The bidder guarantees all equipment, materials and/or workmanship for a period of one 1 year after final inspection and acceptance and shall replace promptly any defective equipment, materials and/or workmanship required without additional cost to the city.

Awards will be made to the bidder quoting the lowest net price in accordance with the specifications. The procurement officer shall award the contract to the lowest responsible and responsive bidder.

Bidders must demonstrate experience servicing heavy-duty diesel vehicles or fire apparatus, familiarity with Cummins engines and equivalent systems, availability of a properly equipped service facility, ability to meet turnaround expectations, flexibility to accommodate operational needs, ability to handle multiple units per week if required, ability to maintain consistent throughput, and capability to perform Massachusetts state vehicle inspections. Supporting documentation including company background, certifications, and references from a minimum of 3 municipal or fleet clients is requested.

If any product is found that does not meet the analysis submitted by the bidder, the purchasing agent may reject the product and require its removal and replacement, or retain the product and compensate the contractor as determined by the purchasing agent and city manager. Violation of provisions regarding illegal, criminal, or shocking behavior can lead to immediate termination of the contract.

Samples of the product to be delivered may be taken by a representative of the city, either prior to delivery or while it is being delivered, or from storage facilities. Bidder agrees to furnish the necessary manual labor, without additional cost, required to assemble the physical samples.

Any prospective bidder requesting a change in or interpretation of existing specifications or terms and conditions must do so within five 5 days (Saturdays, Sundays, and holidays excluded) before the scheduled bid opening date.

Bids which are incomplete, not properly endorsed or signed, or otherwise contrary to instructions will be rejected as informal. Conditional bids will not be accepted. Failure to contract and provide a bond within ten 10 days of notice may result in the bidder being deemed to have abandoned the contract.

Responses to this RFI are due by 10:00 AM ET on October 15th, 2026.

All materials, equipment, software, and labor provided must be warranted by the prime contractor for one year from operational start.

The prime contractor must hold valid West Virginia contractor licenses for plumbing and HVACR. All prime and subcontractor personnel must have appropriate licensures and certifications.

An in-person industry day will be held on November ****, 2026, at the specified VA Medical Centers. Attendance is mandatory for participation.

The total estimated contract capacity over the life of the BPA is projected to be $9,000,000.
