Payments are subject to the continuing availability of funds. A five percent (5%) retainage will be deducted on all invoices when the contract is over $150,000. Lien waivers are required for each application for payment.

Contractor shall provide written warranties including manufacturer equipment warranties, labor warranty, and applicable subcontractor warranties. Warranty documentation shall be submitted prior to final acceptance and payment.

The contract will be awarded to the most responsive, responsible, and best-value offeror, which may not necessarily be the lowest-price offeror. Value added benefits such as quality, safety, responsiveness, service, innovation, and reliability will be evaluated.

Prospective offerors must demonstrate responsibility, including adequate financial resources, ability to comply with the schedule, satisfactory records of performance, integrity, and ethics, and be otherwise qualified and eligible for award.

In the event of failure to deliver services in accordance with contract terms, the owner may procure services from other sources and hold the offeror responsible for any costs resulting in additional purchase and administrative services. Breach of contract or default authorizes the owner to purchase like services elsewhere and charge the full increase in cost to the defaulting offeror.

A mandatory site visit meeting is required for all prospective offerors on June 23, 2026, at 10 AM MT at the Mesa County Justice Center.

Protests must be submitted in writing to the Chief Financial Officer within seven (7) business days after the aggrieved person knows or should have known of the facts giving rise thereto.

Direct communication about this specific project with any county staff not assigned to the project is not appropriate and may result in disqualification. Proposals received after the deadline will be considered nonresponsive.

To demonstrate its qualifications for the project, the bidder must submit safety records. Safety records shall include citations for all serious violations, willful violations, and/or repeat violations issued by the Michigan department of licensing and regulatory affairs, Michigan occupational safety and health administration MIOSHA within the prior 36 months.
