Payments will be made in accordance with the schedule found in the agreement. Final payment on the agreement shall be made in 45 days after successful completion of the services. The City shall withhold retainage on agreements having a total project cost between $100,000 and $200,000, and shall withhold retainage on agreements whose total project cost exceeds $300,000. When withheld, retainage shall equal no more than five percent of each progress payment.
The contractor warrants that all work performed under this agreement conforms to the agreement requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the contractor or any subcontractor or supplier at any tier. This warranty shall continue for a period of 1 year from the date of issuance by the City of written final completion of the services.
All qualified proposals will be evaluated and acceptance made of the proposal judged by the City of Concord to constitute the best value offered for the purpose intended. Evaluation will include, but not necessarily be limited to, the bidders qualifications, experience, past performance, financial standing and bid price.

If contractors obligations are not completed by the completion date or other specified and directed dates for completion of a portion of the work as scheduled between the city and contractors, the city reserves the right to nullify this agreement, order the contractor to immediately cease all work under this agreement and vacate the premises, and to seek professional services equivalent to those outlined in exhibit a. The contractor shall be held accountable for all damages incurred by the city as a consequence of the missed completion date or other specified and directed date for completion of a portion of the work as scheduled between the city and contractors.
Proposers should have no contact with elected officials or appointed officials. Any such contact will subject bidders to immediate disqualification.
