This is an expansion of a contractor pool for landscaping and mowing services. Payment terms include approximately 30 days after service completion and acceptance. Disputes are handled through a defined procedure, potentially involving mediation, arbitration, or court. Warranties cover the quality and professional skill of services provided. Contractors must maintain specific insurance coverages, including commercial general liability, professional liability, automobile liability, and workers' compensation. The agreement is nonexclusive. Contractors are responsible for background checks and drug screening of employees. Uniforms and ID badges are required for employees on CMHA properties. Contractors must adhere to safety precautions and pay prevailing wages. All work areas must be clearly marked, and contractors are responsible for cleaning up debris. CMHA is exempt from Ohio state sales and use taxes and federal excise taxes. The contract commencement date is upon CMHA's execution and issuance of a contract award.
The successful proposer agrees to deliver to the designated locations on or before the date as specified in the finalized contract. Failure to deliver on or before the specified date constitutes an event of default.
CMHA will pay properly submitted invoices in approximately 30 days, contingent upon review and acceptance of deliverables. Payments may be reduced for performance standard deductions.
Services provided under the contract shall be under warranty for 6 months after completion of a work order, guaranteeing the work to be free from defects in material, workmanship, and labor.
Contractors shall perform national criminal history checks and 10-panel drug screening tests on all prospective employees performing work under this contract or coming onto a CMHA property.
A 25 penalty applies for each failed inspection and a 25 per day penalty applies for each day work goes over schedule per section 4. 0 of the scope of work.
If the contractor does not agree with CMHA's action (e. g. , warning, termination), they have 10 days to dispute or protest in writing.
Prospective employees with a criminal background check disclosing a misdemeanor or felony involving crimes of moral turpitude, sexual offenses, or harm to persons or property shall not be employed. Failure to submit drug screening results may lead to contract suspension or termination.
