Sealed bids will be received until 4:00 p. m. , Monday, June 22, 2026.

The materials/supplies/equipment furnished shall be covered by the manufacturer's most favorable commercial warranty. Each bidder shall plainly set forth the warranty for the goods in the proposal.

Award shall be made to the lowest responsible, responsive bid or bidders, taking into consideration quality, performance and the time specified in the proposals for the performance of the contract.

Vendors must be qualified and registered with the NC Secretary of State.

The county reserves the right to conduct any test/inspection it may deem advisable to ensure services/materials/supplies/equipment conform to specifications.

Bids may be rejected if they show omissions, alterations of form, additions not called for, conditional proposals or any irregularities of any kind. Any bidder that designates its entire proposal as a trade secret may be disqualified.

The solicitation has been extended to Tuesday, June 16, 2026, at 3:00 PM EST.

Payment preference is WAWF (Wide Area Workflow). If you do not have a WAWF account, you are unable to receive payment from Norfolk Naval Shipyard as payment is paid through WAWF.

The contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

The award will be given based on lowest price technically acceptable (LPTA). All quotes will be evaluated for both technical acceptability and price reasonableness.

Vendors must provide a detailed unpriced capabilities statement for review and acceptance by the technical POC. The technical capability portion of the quote should include: lead time for each item, complete list of supplies per the SOW, and name of the manufacturer and country of origin.

Delivery is requested ASAP after notice of award, receipt of purchase order, or authorized calls for delivery, unless otherwise specified. Bidders guaranteed delivery is days. The county reserves the right to reject any bids that propose a lengthy delivery schedule if the items are required promptly.

County terms of payment are 2 10 net 30. Bidder may offer alternate terms here: discount and alternate terms will not be used in award determination.

Bidder must warrant that the goods shall be delivered free of the rightful claim of any third person by way of infringement of patents, trademarks or copyright. In the event that such a rightful claim is made the bidder shall either secure permission for the county to rightfully use the goods, replace the goods with equivalent goods free and clear from all rightful claims for infringement of patents, trademarks or copyright, or refund to the county the full purchase price of the goods.

Delivery time may be a factor in determining the winning bidder.

The purchasing agent reserves the right before making award to make investigations as to whether or not the items, qualifications or facilities offered by the bidder meet the requirements set forth herein and are sufficient to insure the proper performance in the event of an award. The bidder must be prepared, if requested, to present evidence of experience, ability and financial standing.

Should the vendor fail to perform as required by the specifications, the county may cancel the order and terminate the order contract. In such event, the county will assume no responsibility for, nor will it reimburse the vendor for any expense or loss to the contractor because of such termination or cancellation. County will then purchase products/service on the open market and charge back the difference to the defaulting vendor.

When required must be delivered prior to the bid opening and free of charge. Samples will be returned at bidders expense and bidder is required to arrange for pick up.

Vendors protesting or disputing bid specifications must do so in writing during the bid opening period prior to the due date to be considered. Such protests must be in the possession of the bureau of purchase and supplies three working days prior to the bids opening.

Failure to complete this bid in its entirety may result in disqualification. Copies obtained from any other source are not considered official documents and will be considered incomplete if missing addenda, if any, resulting in disqualification.

Proposals must be received by Tuesday, July 28, 2026, at 3:00 PM local time. Smart's preferred delivery window for the buses is 365 days or less.

The City will pay the supplier in full within thirty (30) days of acceptance of delivery of the equipment.

Equipment warranties are attached as Exhibit B to the Goods and Services Contract. Supplier will promptly and thoroughly perform all warranty services.

Selection will be made on a best value purchase basis, considering responsiveness, product design and performance (Altoona results), manufacturer's past performance, and delivery schedule.

Proposers must demonstrate the ability to meet required specifications, complete the proposal form, submit references from three transit customers, and include required certificates like Buy America and Altoona test results.

The successful proposer will be subject to a liquidated damages clause for late delivery of buses.

Award protests must be received by August 27, 2026, no later than 3:00 PM local time.

Contacting any city staff or official other than the project manager concerning this RFP will be grounds for disqualification.
