Sealed bids are due Tuesday, September 16, 2025, by 2:00 PM, local time, at the owner's office. Bidders must examine the bid package thoroughly, including the work site and surrounding area. Bid security is required, in the form of a cashier's check or certified check, or a bid bond. The contract includes a one-year replacement warranty for all plant material. The contractor is responsible for any damage to existing facilities or property caused by the work. The village reserves the right to adjust the total number of trees and/or the number of any species of tree to be planted, either up or down, dependent upon the current budget or until budgeted funds are depleted without prejudice to the contract. Payment will be based on accepted unit prices and will be made upon satisfactory completion of the work determined by the village. Invoicing shall be allowed only after trees are planted and accepted in accordance with this contract. All invoices shall be accompanied by a detailed description of work performed. Detail shall include, but not be limited to the examples listed below, and shall be approved by the village. The contractor shall meet with the village administrator or his designee to review the contract specifications and schedule the work. The contractor shall, at all times, have a representative on the work site who understands and speaks fluent English and who has full authority to act for contractor and to receive and execute orders from the village administrator or his designee. Each crew shall have one designated lead person responsible for directing the crew and following all terms and conditions of this contract as detailed within. During the construction period, all phases of work shall be available for inspections by the village. All plant material shall be subject to inspection and approval, and the village reserves the right to reject any plants which fail to meet the standards of this inspection. The village reserves the right to inspect nursery stock either at place of growth or at site for compliance with requirements of variety, size and quality. The contractor shall provide instructions on how to care for the newly planted trees. The contractor shall provide a replacement warranty for all plant material and shall guarantee all work free of any defect in quality or workmanship for a minimum period of one 1 year or until final inspection and written acceptance by the village. The warranty period will be from the date of the village's written preliminary acceptance of the initial installation and will continue through the end of the following year's growing season upon the final inspection and written acceptance of the work. The warranty shall provide against defects including death, unsatisfactory growth, and provides the material to be in good, healthy and flourishing condition, except for defects resulting from neglect by the village, abuse or damage by others or unusual phenomena or incidents which are beyond contractor's control. For verification of such defects, neglect, abuse or damage by others the contractor must notify the village in writing immediately upon identifying said occurrences. During the warranty period, should the appearance of any plant die, indicate weakness and/or probability of dying, the contractor shall immediately begin replacement of said plants with new and healthy plants of the same type and size as soon as weather conditions permit and within a specified planting period after notification of such occurrences from the village without additional cost to the village. The contractor shall make all necessary repairs of damage due to plant replacements. Such repairs shall be done at no extra cost to the village. Replacements shall be in accordance with and subject to all requirements of landscape installation, mulching, maintenance, warranty and acceptance procedures. The contractor shall provide a replacement warranty for all plant material and shall guarantee all work free of any defect in quality or workmanship for a minimum period of one year or until final inspection and written acceptance by the village.
The contract shall be awarded to the lowest, responsible bidder for parkway tree planting.
The owner intends to award the contract only to a bidder that furnishes satisfactory evidence that it has the requisite experience, ability, capital, facilities, plant, organization and staffing to enable it to perform the work successfully and promptly and to complete the work for the contract price and within the contract time.
Should contractor fail to complete the work within the time specified in the contract, the contractor shall be liable to the village in the amount of one hundred dollars (****), as liquidated damages, for each calendar day of overrun in the contract time.
Each prospective bidder shall inspect in detail the work site and the surrounding area and shall familiarize itself with all local conditions, including subsurface, underground and other concealed conditions, affecting the contract, the work and the work site.
