The vendor warrants to the county that all services shall be performed in accordance with acceptable standards in the industry applicable to the services. The vendor shall correct, at its sole cost and expense, any work reasonably deemed to be unsatisfactory by the county. The vendor warrants to the county that all services shall be in strict compliance with the terms of this contract, and all applicable governmental laws, rules and regulations.
Selection will be based on the determination of which proposal best meets the needs of the county and the requirements of this RFP. Proposers are advised that the lowest cost-responsive proposal will not necessarily be awarded the contract, as the selection will also score on professional and technical completeness, per the scorecard attached to this bid.
In order to be considered as responsive, all proposers must answer and provide justifications for all below minimal requirements. The information requested below is to be answered directly in the scorecard excel file by all vendors and submitted as part of your proposal. This includes providing appropriate licenses and certifications, a current Shelby County business license if applicable, active equal opportunity compliance BRN and vendor number, adherence to Title VI requirements, acknowledgment of the Tennessee Lawful Employment Act, completion of Form A and Form B if applicable, a drug-free workplace affidavit, a minimum of five years of experience, a bank certified check or bid bond, attestations of experience managing adult detention facilities with specific accreditation, ability for contract startup within 30 days, demonstrated personnel recruiting capabilities, minimum insurance requirements, and a TennCare provider number and credentialing for the juvenile component.
The contractor agrees that failure to meet the requirements of the agreement will result in a deduction of pay in an agreed amount as determined in the contract until the contractor is in compliance. Failure to meet requirements may include performance deficiencies and/or staff shortages resulting in performance deficiencies. Once deficiencies are identified by the contract/clinical compliance unit, specific corrective action plans (CAPs) approved by Shelby County Division of Corrections must be submitted that include timeframes for subsequent remedies.
A mandatory pre-bid meeting will be held April 23, 2026, at 10:00 a. m. at **** Mullins Station Road, followed with a tour of all facilities.
Upon notice of a bid award, bidders may protest the award by submitting their protest in writing to the administrator of purchasing. The protest must be received within two calendar weeks of the award selection.
