Hays County is issuing an Invitation for Bid (IFB) for hot mix overlay on Fairview Road. The project involves removing existing 5-inch hot mix and replacing it with 5-inch Type B hot mix, and a 2-inch Superpave Type D hot mix overlay. Bids are due by 3:00 PM CT on June 8, 2026. A pre-bid meeting is scheduled for May 27, 2026. Contractors must submit proposals electronically through BidNet Direct or as a hard copy. Questions must be submitted in writing by May 28, 2026. A bid bond of 5% of the total bid amount is required. The contract term is from award in July 2026 to completion by September 25, 2026. Liquidated damages of $500 per calendar day will apply for delays beyond September 25, 2026.
Proposals must be received no later than 3:00 p. m. local time on June 8, 2026. The project must be completed by September 25, 2026.
Payment shall be made by check or warrant by county upon satisfactory delivery and acceptance of products and services and submission of an invoice. Accrual and payment of interest on overdue payments shall be governed by Tex. Govt Code Ann. , Ch. 2251.
The successful respondent expressly warrants that all services specified in the IFB will be performed with care and diligence and in accordance with all specifications of the IFB. The successful bidder agrees to correct any deficiencies in performance of services upon notification by the county and without additional expense to the county.
The county reserves the right to award a contract to a bidder on the basis of unit price low bid and/or the best value for the county. The bid award shall be based on, but not necessarily limited to, total price, special needs and requirements of Hays County, vendors past performance record, and Hays County's evaluation of vendors ability to perform.
A prospective bidder must affirmatively demonstrate bidders responsibility, including having adequate financial resources, ability to comply with delivery schedules, a satisfactory record of performance, proper equipment, and familiarity with applicable laws and regulations. A list of at least three references is required.
If the work is not substantially complete by September 25, 2026, the contractor shall pay the county $500 for each calendar day of delay as liquidated damages.
A pre-bid meeting is scheduled for Wednesday, May 27, 2026, at 9:00 am CT at the Hays County Transportation Department, **** Yarrington Road, Kyle, TX ****.
If the contractor does not agree with any document, notice, or correspondence issued by the purchasing agent, the contractor must submit a written notice to the purchasing agent within ten 10 calendar days after receipt of the document, notice, or correspondence.
Failure of a vendor or any of its representatives to observe the restriction on contacting county staff (other than purchasing office staff) may result in disqualification of any related offer. Failure to comply with the System for Award Management (SAM) requirements may also lead to disqualification.
