Payment will be made upon completion of the project or receipt of goods, unless another payment schedule is specified. the city of warwick, acting as duly authorized through its purchasing agent/finance director/mayor, accepts the above bid and hereby enters into a contract with the above party to pay the bid price upon completion of the project or receipt of the goods unless another payment schedule is contained in the specifications.

Failure to comply with the warranty may result in contract termination and reimbursement of costs, including attorney fees. any proven violation of this warranty and representation by a bidder at the time of the bid or during the course of the contract, included, but not limited to negligent acts, either directly or indirectly through agents and/or subcontractors, shall render the bidders contract terminated and the bidder shall be required to reimburse the city for any and all costs incurred by the city, including reasonable attorney fees, to prosecute and/or enforce this provision.

Delivery timelines are: FSS: 60 days after date of award; LRS: 30 days after date of award; MXG: 180 days after date of award.

Minimum 1-year warranty for all equipment. Warranty must cover all defects not caused by government misuse.

Offerors shall return a copy of this solicitation with all representations filled in. Offerors may elect to use their representations in sam. gov to fill this requirement.

Date of delivery will be no later than January 1, 2027.

Upon acceptance of the street sweeper, the city shall pay the supplier the sum of xx100 ex xxx, xxx. xx dollars.

Manufacturers warranty shall be not less than 1 one year on entire vehicle.

The city council will make all decisions regarding selection and awarding contracts. The decisions of the governing body will be considered final.

Bids from qualified vendors are solicited.

If the street sweeper is not delivered by January 1, 2027, the supplier shall pay the city **** per day as liquidated damages.

The bid security will be retained by the city as liquidated damages should the successful bidder refuse or fail to enter into contract agreement within ten 10 days from the date of notice of award.

Delivery is required within 90 days ARO (After Receipt of Order).

Payment will be made by the Department of Veterans Affairs Financial Services Center. Invoices shall be submitted upon acceptance of items. Net 30 terms are indicated.

Standard manufacturer's warranty is required.

The government will award a contract to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. Evaluation factors include technical, past performance, and price.

Offerors must be registered in the System for Award Management (SAM) and, if applicable, verified in SBA Small Business Search. Vendors must be an OEM, authorized dealer, authorized distributor, or authorized reseller, verified by an authorization letter from the OEM.

The contract may be canceled, terminated, or suspended in whole or in part, and the contractor or subcontractor may be declared ineligible for further government contracts in the event of noncompliance with certain clauses.

Offers from unverified firms will be considered nonresponsive and ineligible for award. Failure to furnish required representations or information, or rejection of terms and conditions, may lead to exclusion from consideration.
