The contractor shall agree to complete the work within 365 calendar days from receipt of the notice to proceed.

Not less than the minimum salaries and wages as set forth in the bid documents must be paid on this project.

The contractor guarantees the work done under this contract and the materials furnished by him and used in the work are free from defects, and the guarantee is for a term of one year from and after the date of the certificate of project completion.

If the contract is awarded, it will be awarded on the basis of the lowest bid and the selected alternative andor optional bid items, if any.

The owner may make such investigations as he deems necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish to the owner all such information and data for this purpose as the owner may request.

If the contractor neglects, fails or refuses to substantially complete the project work within the time of completion as specified herein, or any proper extension granted thereto by the owner in accordance with the general conditions, then the contractor shall agree, as part consideration for the award of this contract, to pay to the owner a liquidated damage for breach of contract for each and every calendar day that the contractor shall be in default on the subject project.

Prior to bid submittal, it is the responsibility of each bidder to visit the project site and verify and become familiar with existing site conditions and other site attributes which may affect performance of the proposed work.

All disputes arising under this contract or its interpretation, whether involving law or fact or both, or extra work, and all claims for alleged breach of contract shall within ten 10 days of commencement of the dispute be presented by the contractor to the owner for decision.

The bid notice states that the submission deadline is a hard close and the system will reject responses with errors and will not allow late submissions. The close date time is 6/4/2026 02:00:00 PM CT.

The question cut off date is 5/28/2026 12:00:00 PM CT.

The bid due date and time for submission of proposals is May 27, 2026, at 2:00 PM EST. The delivery of all materials from this bid will be made to the HCSD Distribution Center at 200 Jerry Barker Drive, Warner Robins, GA ****.

The bid notice states that HCSD shall make payment for goods and services within thirty (30) days upon receipt, inspection and acceptance by HCSD personnel and receipt of invoice. Payment may be made by check or by credit card.

The bid notice states that the award will be made to the vendor who in the HCSD's opinion is most responsive and responsible and will perform in the best interest of HCSD. Price alone may not be the determining factor in award of this bid. Price guarantee will be used as a part of bid evaluation. Additional fees for use of a credit card may be used as part of the award criteria. Delivery date may be used as part of the award criteria.

The bid notice requires bidders to submit a minimum of 3 references, with preferred references from other school systems in Georgia. Attachment B requires certification that the vendor is not debarred, suspended, ineligible, or excluded from doing business with the federal government. Attachment C is a non-collusion affidavit.

The bid notice mentions that if an awarded bidder declines their award, the bidder will be considered a nonresponsible bidder and future bids may be rejected for up to three years. It also states that collusive bidding is a violation of state and federal law and can result in fines, prison sentences, and civil damage awards.

The bid notice does not mention any requirement for a site visit.

The bid notice states that samples are required for any other model/brand not specified by HCSD and that samples are due by May 27, 2026, at 2:00 PM EST.

The deadline for written questions is May 14, 2026.

The bid proposals must be received on Wednesday, June 3, 2026, at 11:00 AM prevailing local time.

The City reserves the right to award this contract based on funds available.

All bidders are required to be registered with the New Jersey Department of Labor if they elect to bid public works projects and must comply with the Public Works Contractor Registration Act. Bidders must also comply with business registration provisions of N. J. S. A. 52:33-4. Additionally, a certificate of consent of surety with power of attorney for the full amount of the bid price from a surety company authorized to do business in the state of New Jersey is required.

Upon failure to execute the contract and furnish a satisfactory performance bond within ten days after award, the bidder shall forfeit the deposit as liquidated damages.
