If delivery is not completed by the promised time, the authority can terminate the contract and charge the contractor for losses incurred. if delivery of acceptable items or rendering of services is not completed by the time promised, the authority reserves the right, without liability, in addition to its other rights and remedies, to terminate the contract by notice effective when received by contractor, as to stated items not yet shipped or services not yet rendered and to purchase substitute items or services elsewhere and charge the contractor with any or all losses incurred.

The work, including punch list items, must be completed within 60 calendar days of the notice to proceed. An additional 10 days are granted if additive alternate 1 is awarded. The anticipated start date is September 8, 2026.

Five percent of each approved estimate will be retained by the owner. Partial payments will be made monthly based on the engineer's estimate of work completed, after submission of sworn statements and releases of lien.

The contractor warrants that all materials and equipment will be new and all work will be of good quality, free from faults and defects. The contractor shall promptly correct any defective work within one year from the final completion date.

The contract will be awarded to the lowest responsible bidder whose evaluation indicates the award will be in the best interests of the owner. The owner will consider bidder qualifications, compliance with requirements, and alternates.

Bidders must demonstrate qualifications to perform the work, including financial data and previous experience. They must be reputable with a satisfactory history of providing the required work.

Liquidated damages of **** will be assessed for each calendar day the work is not substantially complete within the specified time.

Bidders must visit the site to familiarize themselves with local conditions that may affect the cost, progress, or performance of the work. Access to the site will be provided on request.

A bidder may withdraw their bid due to a material and substantial mistake, but will be disqualified from further bidding on the work. Failure to pass the owner's evaluation of responsibility can also lead to rejection.

Deliveries shall be in bulk shipments of 4,400 gallons each and must be completed within eight 8 hours of order placement to the receiving location.

The goal of the authority is to pay properly submitted contractor invoices within thirty 30 days of receipt, providing goods have been delivered andor services have been performed, approved and accepted by the greater rockford airport authority.

Contractor warrants that all goods and services furnished hereunder will conform in all respects to the terms of this solicitation, including any drawings, specifications or standards incorporated herein, and that they will be free from latent and patent defects in materials, workmanship and title, and will be free from such defects in design. The contractor further agrees, upon written notice from the authority, to promptly and without charge, make changes, corrections andor replacement, to the satisfaction of the authority, which may be required to make good all defects in design and material under its intended use, for a period of three 3 years, with the three 3 year period commencing on the date of acceptance by the authority.
