To be considered a responsive and responsible bidder, each bidder must submit a statement of qualifications demonstrating their ability to successfully complete the project, including understanding of artificial reef construction, fabrication of similar reef units, marine construction experience, and knowledge of the region. Each of these criteria will be evaluated on a pass/fail basis, and a bidder must receive a pass on all four criteria to be deemed qualified.

The bid notice mentions that if the bidder to whom the contract is awarded refuses or neglects to execute it or fails to furnish the required bonds and insurance within the time specified, the amount of his bid security may be retained by ARRC as liquidated damages. The payment schedule is as follows: 10% upon approval of submittals, 40% upon approval of fabrication and quality reports, and 50% upon acceptance of delivered fenders.

Vendor warrants that the equipment, goods, materials or other supplies sold to ARRC under this contract shall be of good quality and free from all defects and deficiencies in workmanship, material and design, shall be fit, suitable and operate successfully for their intended purpose, shall be new, shall be free from all liens, claims, demands, encumbrances and other defects in title and shall conform to the specifications, if any, stated in the contract. Vendor shall honor all guarantees and warranties offered by the manufacturer of the equipment, goods, materials or other supplies provided under this contract.

An award will be made to the low, responsive, responsible bidder that meets the requirements as set forth in the specifications and compliance thereof.

Vendors must be the original manufacturer or an authorized distributor with at least five years of documented experience in the fabrication of fender systems or comparable engineered marine protection products, and be able to provide audited financial statements demonstrating financial ability.

The ARRC may conduct an inspection of the suppliers facility to include its offices and inventory of the items being solicited prior to contract award.

Claims or disputes arising in the performance of this contract which are not resolved by agreement of the parties shall be decided in accordance with ARRC's procurement rules. If the matter cannot be resolved by agreement within 7 days, the contractor shall, within the next 14 days, submit an intent to claim in writing to the project manager. The claim, if not resolved, shall be presented to the project manager, in writing, within 60 days following receipt of the intent to claim.

The car must be returned to the ARRC Anchorage car shop no later than April 27th, 2026, according to the bid notice.

The contractor shall warrantee the finish against defects in materials and workmanship for two years of normal service anywhere on the alaska railroad, as stated in the bid notice.

An award will be made to the low, responsive, responsible bidder that meets the requirements as set forth in the specifications and compliance thereof, according to the bid notice.

The contractor shall have its own rail accessible shop in which to perform all the work required in this solicitation, according to the bid notice.

Liquidated damages will be assessed in the sum of $7,500 therein for each calendar day of delay beyond the date of substantial completion, according to the bid notice.

Questions must be submitted in written form prior to March 17th, 2026, according to the bid notice.

The contractor shall warrant all equipment offered to be free of defects in materials and workmanship. In the event of defects in materials and workmanship, contractors liability obligations shall be to repair or replacedefective parts.

The items to be purchased through this bid are critical to the operation of the ARRC any vendor who respondsto this bid must meet the following minimum qualifications in order to be considered responsive: be the original manufacturer, be the distributor dealer authorized by the manufacturer that routinely maintainsan inventory of the requested product as part of its normal business and is authorized by the originalmanufacturer to serve this area the state of alaska. be listed as a supplier of the requested items in thesupplier quality system register maintained by the national association of purchasing management railindustry group or other nationally published railroad periodical or have at least five years of experience in themanufacture of the requested items. have the authority and capacity to provide full support for all product warranties, including technical troubleshooting support. be able to provide audited financial statements demonstrating the financial ability to meet the requirementsof any order that may result from this solicitation.

The ARRC may conduct an inspection of the suppliers facility to include its offices and inventory of the itemsbeing solicited prior to contract award.

An aggrieved bidderofferor may protest an arrc procurement action by filing awritten protest with the procurement officer in accordance with the procedures and time limits specified in arrcprocurement rules ****.
