Materials purchased under this contract are funded in part by federal Community Development Block Grant money, requiring adherence to HUD supplementary general conditions, including Davis Bacon wage rates, reporting, and nondiscrimination clauses. The City reserves the right to postpone the delivery date. If no date is indicated, delivery will be made within three (3) business days from the date of receipt of the order. Stock orders shall be completed within 48 hours, and emergency orders are expected to be made the same day.
The bid notice states that payments shall be made within **** days of delivery and acceptance of contracted items/services or upon receipt of a verified claim for payment, whichever is later. Payment can also be made by City departments via credit card or EFT payments without additional charges.
The bidder to whom a contract is awarded guarantees that all items furnished under this contract shall be free of defects in design, materials, and workmanship for a period of one (1) year after final inspection and acceptance. The contractor shall promptly replace any defective equipment, materials, and/or workmanship without additional cost to the City.
Awards will be made in the best interest of the City, considering the bidder's ability, capacity, skill, promptness, character, integrity, reputation, judgment, experience, efficiency, quality of performance, compliance with laws, financial resources, quality and availability of supplies, ability to provide future maintenance, and the lowest responsible bidder quoting the lowest net price in accordance with specifications.
The bid notice states that failure to submit all information called for may be sufficient for disqualification. Bids must be complete and accurately filled out, with any exceptions or deviations explained in detail. Bids must be securely sealed and properly marked.
Should the successful contractor fail to make delivery or complete the contract within the time specified, the City reserves the right to procure the equipment/product from other sources and hold the contractor liable for any excess cost. Failure to submit an MSDS and/or label on each container may result in civil or criminal penalties, including bid debarment.
The City shall be given the opportunity to examine the suppliers facility and the source of the supply.
Samples may be tested before awards are made and periodically thereafter. Samples, when requested, must be furnished free of expense. Upon request, if not destroyed, samples will be returned at the bidder's risk and expense.
