To apply, attorneys or law firms must submit a letter of interest and a statement of qualifications that includes the attorneys or firms name, website, principal place of business, email address, and telephone number; the attorneys or firms areas of practice; a summary of the education, experience, and qualifications of any attorney who would be performing substantial legal work or communicating with the client; a summary of relevant cases or other legal work and the names and contact information of up to five clients who may be contacted, including at least two for whom services were rendered during the preceding 12 months and at least one governmental client; affirmative statements on whether the attorney or firm has legal malpractice insurance coverage and whether the attorney or firm has been denied coverage in the past; and an overview of billing policies.

The proposal due date is April 30, 2026, by 4:00 p. m. HST. The primary election is on August 8, 2026, and the general election is on November 3, 2026.

The County of Maui agrees to pay for actual flight time and ground time incurred by the proposer in the collection of election supplies. The fee proposal must include an analysis of compensation components, including hourly rates and potential differential fees.

The award will be made to the responsive, responsible proposer on the basis of best value, which optimizes quality, cost, and efficiency as determined in the evaluation process. The contract will not be awarded solely on the basis of lowest cost.

Proposers must provide a description of their firm, including organization date and incorporation details. They must indicate their classification (local, regional, national, or international) and provide a history of their experience in providing air transportation for time-sensitive cargo, including years in business and safety records. Names of three clients with contact information are required, along with a five-year safety record and a list of lost accounts in the last three years. A description of all litigation or legal proceedings from the past five years is also required.

The proposer understands that failure to meet contract requirements will constitute a breach of contract that may result in suspension or debarment, and the exercise of rights and/or remedies as provided by law.
