Payment terms are net thirty 30 days unless an early payment discount is quoted. The bid notice states, Payment discounts offered for payment in less than twenty 20 days will not be considered as a basis of award. The lowest responsible bidder shall be determined by considering the quality and performance of supplies, the ability and capacity of the bidder to perform, the ability to perform within the specified time, the character, integrity, reputation, judgment, experience, and efficiency of the bidder, the quality of previous performance, and the ability to provide future maintenance, repair parts, and services.

The owner may investigate the bidder's ability to perform, requiring information on adequate capital and credit rating, an efficient office force, an adequate and efficient field force, a record of amicable relations with labor, and an adequate supply of applicable equipment in good operating condition.

Liquidated damages of **** per day will apply for exceeding the schedule, as stated in the contract documents. The bid notice also mentions that if the contractor fails to correct unsatisfactory conditions within five days after notification, the contract may be terminated, and the contractor and/or its surety shall be liable for any and all costs for reprocurement and completion of the contract.

If a notice to proceed letter ntp is issued to the winning bidder and proper authority is given to proceed, the work shall commence on the designated start date, and the work shall be completed by or before the designated completion date per the ntp and determined by the city, with a **** five hundred **** us dollars per day in liquidated damages for exceeding the schedule will apply.
