Failure to submit breakout sheets with the proposal will result in the proposal being declared non-responsive and rejected. failure to submit the breakout sheet with the proposal will result in the department declaring the proposal as non responsive and rejecting the bid.

The prime contractor agrees to pay each subcontractor under this prime contract for satisfactory performance of their contract no later than 30 days from the receipt of each payment the prime contractor receives from the recipient. The prime contractor agrees further to return retainage payments to each subcontractor within 30 days after the subcontractors work is satisfactorily completed.

In accordance with title 29, subsection **** of the Delaware code, a penalty of $2,**** will be withheld from the successful bidder for each occurrence for the failure to utilize any or all of the subcontractors set forth below.

Protests based upon restrictive specifications or alleged improprieties in the bidding procedure shall be filed in writing with DTC's Finance Administration Manager at least ten (10) calendar days prior to the bid opening. Protests based upon the award of a contract shall be submitted in writing to DTC's Finance Administration Manager no later than ten (10) calendar days following the award of the contract.

Failure by the contractor to carry out DBE requirements is a material breach of this contract, which may result in the termination of this contract or such other remedy as the recipient deems appropriate, which may include, but is not limited to: withholding monthly progress payments, assessing sanctions, liquidated damages and/or disqualifying the contractor from future bidding as nonresponsible.

Bidders with scores less than 85 may bid if they comply with retainage requirements. bidders with performance rating scores equal to or greater than 85 shall be permitted to bid.

Proposals are due by Tuesday, August 4, 2026, prior to 2:00 p. m. local time.

DelDOT will pay vendors monthly, within thirty (30) days of receipt of the vendor's billing, for legitimately earned amounts supported by data and an itemized accounting of reasonable reimbursable direct non-salary costs. Final settlement will be made within thirty (30) days from the date of final written state acceptance of the work and services.

The vendor will provide a warranty that the deliverables, including equipment and construction, will function as designed throughout the length of the contract. The vendor must correct any setup, configuration, customizations, or modifications at its own expense to meet the state's requirements. A sample warranty should be included with the proposal submittal.

Proposals will be evaluated based on community benefit and impact, project feasibility and readiness, accessibility, and cost-effectiveness. The selection committee will rank proposals based on these criteria.

Vendors must be qualified and responsible, possessing the necessary financial, physical, and personnel resources. They must also have a good record of performance and integrity, and be legally qualified to contract with the state. The prime consultant must be registered with DelDOT at or before the time of submission.

The state of Delaware may include liquidated damages provisions in the final contract for nonperformance, based on a service level agreement with tiered penalties for incidents.

Before any contract is awarded, successful vendors may be required to furnish a complete statement of the origin, composition, and manufacture of any material to be used, along with samples for testing.

Vendors may be disqualified for submitting more than one proposal for the same contract, evidence of collusion, unsatisfactory performance records, suspension or debarment, or submitting incomplete, indefinite, or ambiguous proposals.

The maximum available award for this RFP opportunity is $8,000,000.
