Payment shall be made on the pay period after receipt and acceptance of goods and/or services and upon using department confirmation of such acceptance.

In case of default by the vendor of any of the conditions of this solicitation or contract resulting from this solicitation, the vendor agrees that the city may procure the articles or services from other sources and may deduct from the unpaid balance due the vendor, or collect against the bond or surety, or may invoice the vendor for excess costs so paid.

When deemed necessary by the City, an onsite inspection date and time will be so designated. The vendor is responsible for inspecting and understanding the total scope of the projects i. e. , specifications, quality, and quantity of work to be performed.

Solicitation protests must be received by the City's Purchasing Agent not more than five calendar days after the last day for questions or the last addendum is issued, whichever is later. Bid protests must be received by the City no later than seven calendar days after the bid opening.

If it is found that gratuities in the form of entertainment, gifts, or otherwise were offered or given by the contractor, or any agent or representative of the contractor, to any officer or employee of the City with a view toward securing an agreement or securing favorable treatment, the City may terminate the right of the contractor to proceed.

The project completion is scheduled for October 1, 2026. The contractor agrees to commence work on or before a date to be specified in the notice to proceed and to fully complete the project by Oct. 1, 2026.

Based on invoices submitted by the contractor, the city shall make payments for actual work performed. For contracts with a value of $50,**** or greater, the city shall retain five percent (5%) of the calculated value of the completed work.

The contractor shall guarantee and warrant all the workmanship and materials against any defects for one year from date of final acceptance.

Bidders must demonstrate their experience in trades related to the work and provide a list of at least three successfully completed projects of a similar nature, including size, description, date, dollar amount, and responsible person.

Should the contractor fail to complete the work within the contract time, the contractor shall pay the city as liquidated damages, and not as a penalty, the sum of $1,**** for each consecutive calendar day the project remains incomplete.

There will be a nonmandatory prebid conference at 1:00 PM local time on June 11, 2026, at the Community Development Building, located at 215 E. 12th Street, Durango, CO ****.

Questions must be submitted via the Rocky Mountain e-Purchasing system website by June 15, 2026, 3:00 PM local time. Questions received after the deadline may not be accepted.

Any bid that fails to conform to the essential requirements of the invitation for bid will be rejected. Bids shall be rejected when the bidder imposes conditions that would modify requirements of the invitation or limit the bidders liability to the city.
