The Brownsville Public Utilities Board is accepting bids for 15. 5 kV outdoor vacuum breakers for the Titan Substation. Bids can be submitted electronically or sealed until March 25, 2026, at 5:00 PM. The bid opening will be on March 26, 2026, at 10:30 AM. A supply bond and contract execution are required. Clarifications can be directed to Hugo E. Lopez. The BPU reserves the right to reject any or all bids. The delivery must be made within the last quarter of 2026. The vendor must send a personal representative with binding authority for the company to the Brownsville Public Utilities Board upon request to make adjustments andor assistwith coordination of all transactions as needed. The successful vendor must agree to receive payments via ach direct deposit. The bid is valid for 90 days. The owner is exempt from texas sales tax on materials. Failure to sign bid will disqualify it. The vendor must provide a completed form **** at the time the signed contract is submitted to bpub.
The bid notice states delivery shall be made within the last quarter of 2026.
The purchaser shall, within thirty 30 days of the later of i full receiptof the equipment at the delivery location and ii receipt of the invoice of seller for the equipment, pay to the seller ninetyfive percent 95 of the contract price of the equipment, subject to thedispute of any amounts by purchaser in good faith.
The manufacturer shall warranty each breaker against defects in equipment, materials, andor workmanship including any and all third party materials for a period of not less than five 5 years.
The determining factors for award are: bidders net price on bid items, stock availability, reputation of brand names offered, reputation and location of the bidder, time and conditions of delivery, bpub financial and legal responsibility evaluations of any identified teaming arrangements involving significant joint ventures, subcontractors and suppliers contract with vendorentity indebted to bpub.
The proposing firm must: have demonstrated experience in the following: a. firm will be evaluated with respect to its experience and their personnel 1 provide a description of your agency and resume on the personnel who would be assigned to the project. 2 demonstrate sufficient capacity, resources and experience to build the unit as required in the **** 15. 5kv outdoor vacum breakersfor titan substation 4 2. have been in business for a minimum of five 5 years providing the scope of services consistent with those sought in this rfb. 3. have experience providing similar work to at least three 3 other similar type and size entities. 4. not be in bankruptcy or previously filed for bankruptcy, conservatorship, receivership, or in the possession of a regulatory agency. 5. disclose any legal andor regulatory inquiries andor sanctions against the firm or any individuals employed by the firm.
The seller agrees to pay liquidated damages, not as a penalty, the amount of **** per day per transformer, if power transformers are not delivered within the delivery time specified in section 2 of this contract.
