Proposals must be electronically uploaded by August 13, 2026, at 11:30 a. m. it is the respondents responsibility to ensure that the proposal package is uploaded by the bid opening date and time.

Firms must provide proof of licenses, a proven record of experience with references, evidence of qualifications and experience of key team members, proof of approach to cost control and scheduling, and a standardized schedule of fees. Responders must satisfy the following qualification criteria to be selected as a member of the pool:

Any prospective bidder who wishes to challenge a bid specification shall file such challenges in writing with the contracting agent no less than three business days prior to the opening of the bids. Challenges filed after that time shall be considered void and having no impact on the contracting unit or the award of contract.

Failure to submit required items with the proposal is a mandatory cause for rejection. Any bid document received after the deadline established by the department of purchasing will not be accepted, regardless of the method of delivery.

Planting shall be done within the following dates: October 15 through December 15. The contract period shall be for 90 calendar days from the formal notice to proceed. Installation must begin within sixty 60 days from the date of award.

The county of mercer shall pay the submitted bill not more than 30 calendar days after the receipt of the bill by the county if the vendor has performed in accordance with the contract and the work has been approved and certified by the county. The billing shall be deemed approved and certified 20 calendar days after the owner receives it, unless the county provides, before the end of the 20-day period, a written statement of the amount withheld and the reason for withholding payment.

Plant material that is dead or not showing satisfactory growth, as determined by the park commission, shall be promptly removed and replaced by the contractor within ten 10 working days. The replacement shall be of the same variety, size, and character as specified for the original planting.

Contract shall be awarded to the lowest responsible bidder as declared by the county of mercer.

Landscape planting and related work shall be performed by a firm with a minimum of three 3 years of experience specializing in this type of work. Bidders must provide three 3 references indicating past performance on attachment 1.

The county of mercer reserves the right in the event of unsatisfactory service to cancel the contract awarded to the successful bidder and procure the goods or services from other sources and hold the contractor responsible for any excess cost.

An onsite walkthrough is recommended to ensure that the successful contractor has knowledge of scope of project, work zone, layout, vehicular traffic patterns, logistical installation requirements, and scope of preplanting site preparation.

If so requested, the vendor shall provide demonstration. If so requested, the vendor shall submit a sample of the units or merchandise.

Bids containing any conditions, omissions, unexplained erasures or alterations, items not called for in the bid proposal form, attachment of additive information not required by the specifications, or irregularities of any kind, may be rejected by the county.

Work will commence within ten 10 calendar days after receipt of written notice to proceed and be substantially completed within 45 calendar days from the receipt of the notice to proceed.

The county of Mercer shall pay the submitted bill not more than 30 calendar days after the receipt of the bill by the owners representative if the contractor has performed in accordance with the contract and the work has been approved and certified by the owners representative.

Bidders shall have similar experience with hot mix asphalt HMA walkway construction. Bidders must provide three 3 verifiable references.

Pursuant to N. J. S. A 40a:11-19, liquidated damages in the amount of $1,**** may be assessed for the violation of any of the terms of the contract.

A site visit is scheduled for July 8, 2026, at 1:00 p. m. at the Park Commission Hunt House, 197 Blackwell Rd, Pennington, NJ, **** is highly recommended but not mandatory.

Vendors must be qualified to provide instructional technology equipment.

Making false statements or claims in connection with this award is a violation of federal law and may result in criminal, civil, or administrative sanctions, including fines, imprisonment, civil damages and penalties, debarment from participating in federal awards or contracts, and/or any other remedy available by law.
