This solicitation and the resulting contracts or purchase orders will be awarded to the responsible respondents whose acceptable quote is determined to be the most advantageous to the state, with price-cost being the primary consideration. Other considerations may include, but are not limited to, sample quality, and lead time for delivery.

The awarded respondent must provide proof of good standing with the Colorado Secretary of State and an insurance certificate documenting required coverage prior to contract execution.

Calculating and/or deducting liquidated damages based on the vendor failing to meet specifications with certain deliveries does not prevent CDOT from canceling the contract or purchase order if subsequent acceptance samples fail to meet specifications.

Acceptance samples will be taken by CDOT forces at the times and locations of delivery. CDOT will take a minimum of one representative sample per location at a frequency of 1 per 200 tons of delivered chips, or fraction thereof. The vendor agrees that such CDOT sampling and testing procedures are a reasonable means to determine compliance with the specifications.

A quote received after the submission deadline may be rejected. Failure to submit pricing utilizing the price submission form will result in the solicitation response being considered nonresponsive. Any acceptance that fails to meet gradation specifications may be cause for immediate cancellation of the contract/purchase order for that location.

The anticipated term of the contract or purchase order is three (3) months from the date of full contract execution or issuance of final, approved purchase order. Prior to such cancellation, the vendor may be allowed one re-sampling for retesting.

A quote received after the submission deadline may, at the sole discretion of the state, be rejected without further consideration. If an acceptance test fails to meet specifications, the vendor must provide written explanation to CDOT that appropriate action to remedy the problem which caused the material to be out of specification before any further deliveries are made to the sites. Any acceptance which fails to meet gradation specifications may be cause for immediate cancellation of the contract/purchase order for that location at the option of CDOT.
