The selection process is designed to identify the best fit, considering criteria like qualifications and experience (20 points), project team (15 points), project approach (30 points), ability to meet project schedule (10 points), past project references (10 points), fee schedule (10 points), and ability to meet consulting services agreement terms and insurance requirements (5 points).

Respondents must summarize recent experience, including a maximum of five projects completed within the last five years, detailing client, role, and contract amounts.

Violation of the rule prohibiting contact with any other NISP Enterprise or Northern Water board member, officer, employee, or agent may result in disqualification.

All questions must be submitted in writing via RMEPS by Thursday, August 20, 2026 at 12:00 pm MT.

The work shall be commenced by the contractor no later than , and shall be substantially completed not later than . Final completion of the work shall be no later than .

Northern Water shall make progress payments based on applications for payment for work actually completed, less 5 percent retainage. Final payment shall be made within 60 days after the work is completed to the reasonable satisfaction of and finally accepted by Northern Water.

A minimum five-year warranty or the manufacturer's standard warranty, if longer, for crash-rated vehicle barriers and automated slide gate operators. A minimum two-year workmanship warranty covering installation defects, programming and configuration errors, alignment and adjustment issues, and foundation deficiencies attributable to installation.

The contractor represents that its personnel have visited the site and are financially solvent, able to pay its debts, and have sufficient working capital to perform the work. The contractor must also be authorized to do business in Colorado and properly licensed.

The contractor represents that its personnel have visited the site and familiarized themselves with the local conditions under which the work is to be performed.

The contractor shall review, approve and submit all shop drawings, product data and samples required by the contract documents.

In the event of the contractor's noncompliance with nondiscrimination clauses or related rules, the agreement may be canceled, terminated, or suspended, and the contractor may be declared ineligible for further government contracts.

The project completion deadline is May 28, 2027.

Consultant may invoice monthly for completed portions of the work. LBD shall make payment within thirty (30) days from receipt of invoice.

Award of contract will be based on strong firm qualifications, approach, and experience rather than a fee-based selection. Evaluation criteria include project approach (45 points), project team experience and qualifications (15 points), watershed/environmental communication experience (15 points), cost estimate (15 points), and overall quality of proposal (10 points).

Proposals are requested from qualified consultants or firms. The proposal must contain information on organization structure, key staff experience, relevant project experience, and a conflict of interest statement.

LBD may exercise remedial actions such as withholding payment, requesting removal of employees, denying payment for unperformed services, or recovering incorrect payments.

The request for clarification deadline is August 11, 2026.

LBD reserves the right to disqualify any response submitted incorrectly. Late proposals will not be reviewed or scored.

Respondents will be invited to submit supplemental due diligence requests to perform site visits, investigations and/or ground disturbing activities to better inform the bidding process, prior to bids being due. Manufacture and delivery must be before September 25th, 2026.

Northern Water shall pay the seller by check or wire transfer at Northern Water's option, within a reasonable period of time after the date of receipt of an acceptable invoice, or the date of Northern Water's acceptance of the goods, whichever is later.

The seller warrants that all goods will conform with specifications, will be of merchantable quality, and will be fit for the purposes intended. The seller shall replace, repair, or make good, without cost to Northern Water, any defects or faults in the goods arising or becoming apparent within one (1) year after the date of acceptance of the goods.

It is the intent of Northern Water to award this contract to the responsive bidder whose base price bid represents the lowest total cost to Northern Water.

Prior to award of this bid, the successful respondent may be required to demonstrate to Northern Water its experience, qualifications, and capability to provide the services and products specified in the solicitation documents.

When a date is set for the delivery of merchandise or the performance of work, said merchandise must be delivered, or work performed, in accordance with the specifications or description herein contained on or before said date, or the order to the delinquent party may be canceled and awarded to the next lowest qualified responsible bidder. In such case, the district will have the right to buy such articles at market price for immediate delivery, and an excess in cost of same over price named hereon is to be paid by the bidder under this contract or deducted from any money due or hereafter coming to him.

Northern Water reserves the right to reject any bid if the information submitted by the respondent, or the results of Northern Water's investigation, do not satisfactorily demonstrate that the respondent is qualified and capable of fulfilling the obligations of the contract and delivering the required services or products.
