The City of Woburn is soliciting bids for bituminous
concrete. Bidders must submit completed forms, including quality requirements, terms, conditions, price schedules, certificate of authority, and Appendix A. Past performance information may be required. Bids must be delivered by June 30, 2025, at 11:30 AM EST to the Purchasing Department. Questions must be submitted by June 23, 2025. The contract will be awarded within 30 days after the bid opening, potentially extendable by mutual agreement. Bid prices must remain firm for 60 days following the bid opening. The city reserves the right to reject unbalanced, frontloaded, and conditional bids. If the Purchasing Department is closed due to unforeseen events, the bid opening will be postponed. All prices must include delivery, fuel, labor, and other related charges. Estimated quantities are provided but not guaranteed. References to brand names require acceptance of an equal or better brand. A one-year warranty is required. The contract is for one base year with two option years. Invoices must include specific information. The work consists of local roadway improvements, obtaining hot asphalt mix, and furnishing and placing bituminous pavement. The contractor is responsible for supplying bituminous
concrete to the city on a will-call basis. Delays exceeding 30 minutes may be charged back to the vendor. Materials must meet specific temperature requirements. Delivery is expected Monday through Saturday, 7:00 AM to 3:30 PM. Bidders must submit a certificate of authority, insurance certificate, and a certificate of non-collusion. The city may require samples of the goods offered. The contractor must comply with all applicable laws and regulations. The city is exempt from Massachusetts sales tax and federal excise taxes. Verbal orders are not binding. The successful bidder may be required to furnish a performance bond. The contractor is not an agent or employee of the city. The written contract supersedes all prior agreements. The contractor shall not assign any interest in a contract without prior written consent. The city reserves the right to terminate the agreement under specific conditions. Upon termination, the contractor must return all documents, plans, tools, equipment, and items to the city.
