Successful quoters will be held to delivery dates. All quotes will indicate the lead time required for the established quantities to be delivered, which shall be expressed in calendar days.

All invoices will be paid in accordance with the Florida Prompt Payment Act ****.

Award of this quote shall be to the lowest responsive, responsible quoter meeting or exceeding the requirements of the specifications set forth herein. Another consideration of award may be delivery time.

The county reserves the right to reject the quote of any quoter who has previously failed to perform properly, or on time, contracts of similar nature or who is not in a position to satisfactorily perform the contract.

Failure to meet delivery or leadtime necessitating Charlotte County to make purchases from other sources shall cause successful quoter to be held liable for the difference of cost between awarded quote price and the cost of the required purchase from another source.

If, after the due date and time, the lowest quoter is deemed nonresponsible by the county, such quoter shall receive written notice from the county of this determination. The quoter shall have five 5 business days from the date of this notice to dispute the determination and to provide to the county any additional information it deems relevant regarding the quoter's responsibility.

Payment shall be made on the pay period after receipt and acceptance of goods and/or services and upon using department confirmation of such acceptance.

In case of default by the vendor of any of the conditions of this solicitation or contract resulting from this solicitation, the vendor agrees that the city may procure the articles or services from other sources and may deduct from the unpaid balance due the vendor, or collect against the bond or surety, or may invoice the vendor for excess costs so paid.

If it is found that gratuities in the form of entertainment, gifts, or otherwise were offered or given by the contractor, or any agent or representative of the contractor, to any officer or employee of the City with a view toward securing an agreement or securing favorable treatment, the City may terminate the right of the contractor to proceed.

Periodic invoices from completed deliveries. The successful vendor shall submit an invoice to the countys project manager. The invoice shall reference the appropriate purchase order number, the delivery address, and the corresponding delivery ticket or packing slip number that was signed by the authorized representative of the county when the items were delivered and accepted.

Warranty shall be supplied in written form. The vendor shall supply copies of written warranty certificates with its response.

Best evaluative score based on written response: Meet or exceed requested specifications (30%), Availability and warehouse location (20%), Estimated time of arrival after receipt of order (30%), Pricing (20%). it is the intent of the county to award this solicitation to the vendors who receive the highest scores when the responses submitted by interested vendors are reviewed by the countys response evaluation committee.

Minimum three years of experience providing roadway preformed markings comparable in scope and volume. Proposals will only be considered from vendors which have been engaged in the business of performing the work as described in this solicitation.

Deficiencies in work to be corrected by vendor. Failure to correct may result in contract termination and charges for reprocurement costs.
