The contractor is fully aware that the owner i. e. : the state of montana has established a billing cycle for processing payments in article 9 of these general conditions. The contractor and all subcontractors are subject to all provisions of title 28, chapter 2, part 21 mca regarding all aspects of the work.

The contractor warrants to the owner and architectengineer that materials and equipment furnished under the contract will be new and of good quality unless otherwise required or permitted by the contract documents, that the work will be free from defects not inherent in the quality required or permitted, and that the work will conform to the requirements of the contract documents. The contractors warranty excludes remedy for damage or defect caused by abuse, modifications not executed by the contractor, improper or insufficient maintenance, improper operation, or normal wear and tear and normal usage.

The owners engagement of the contractor is based upon the contractors representations by submission of a bid to the owner that it: has the requisite skills, judgment, capacity, expertise, and financial ability to perform the work; is experienced in the type of labor and services the owner is engaging the contractor to perform; is authorized, licensed, and registered to perform the type of labor and services for which it is being engaged in the state and locality in which the project is located; is qualified, willing and able to perform the labor and services for the project in the manner and scope defined in the contract documents and; has the expertise and ability to provide labor and services that will meet the owners objectives, intent, and requirements, and will comply with the requirements of all governmental, public, and quasipublic authorities and agencies having or asserting jurisdiction over the project.

Any changes to wages or penalties for failure to pay the correct wages will be the sole responsibility of the contractor andor his subcontractors and no further charges or claims shall be made to the owner.

Execution of the contract by the contractor is a representation that the contractor has visited the site, become generally familiar with local conditions under which the work is to be performed, and correlated personal observations with requirements of the contract documents.

Samples are physical examples which illustrate materials, equipment or workmanship and establish standards by which the work will be judged. The contractor shall review, approve, and submit to the architectengineer, shop drawings, product data, samples, and similar submittals required by the contract documents within fifteen 15 calendar days of being issued the notice to proceed unless noted otherwise. . .

If the prevailing bidder cannot or does not register in time for the owner to execute the contract within fifteen 15 days of the date on the notice of award, the owner may award, at its sole discretion, to the next lowest responsible bidder who meets this requirement.

Bids will be received until 2 PM, Tuesday, July 21, 2026. sealed bids will be received at the office of the city clerk of the city of lathrop, located at 390 towne centre drive, lathrop, ca until 2 pm, tuesday, july 21, 2026.

Each bidder must be a Department of Industrial Relations (DIR) registered contractor. each bidder submitting a proposal to complete the work, labor, materials andor services work subject to this procurement must be a department of industrial relations registered contractor pursuant to labor code section **** dir registered contractor.

A bidder who is not a DIR registered contractor when submitting a proposal will be deemed not qualified and their proposal will be rejected for nonresponsiveness. a bidder who is not a dir registered contractor when submitting a proposal for work is deemed not qualified and the proposal of such a bidder will be rejected for nonresponsiveness.

System installation must be completed by September 25, 2026, and system winterization by October 31, 2026. Spring system startup must be completed by May 1, 2026.

A 10% retainage will be held until spring system startup is completed. All costs associated with furnishing and installing the irrigation system are the contractor's responsibility.

The irrigation system materials, equipment, and workmanship are warranted against defects for 1 year from the date of acceptance. Repairs must be made within 7 days of notification.

The contract will be awarded to the responsible bidder whose proposal is determined to provide the best overall value to the City, based on a scoring system including experience, technical approach, references, project schedule, and price.

The irrigation installer must be a Rhode Island licensed and registered master irrigator.

A mandatory pre-bid conference will be held on Thursday, July 2, 2026, at 10:00 am on-site at the City Hall Plaza.

Multiple bids by one supplier will not be accepted and will be disqualified. Failure to submit the certification and warrant form will result in automatic rejection.
