Payments will be made within 30 days from approval for ninety percent (90%) of the work completed, until the work is fifty percent (50%) in place. Thereafter, additional retainage shall not be withheld unless it is determined that the contractor is not making satisfactory progress. For contracts less than $30,000 or paid in three or fewer payments, payments will be made within 30 days from approval for 90% of the work completed.
For one year after the date of final payment, the contractor shall maintain and repair the work. Any work found to be defective shall be corrected or replaced at no cost to the road commission.
The contract will be awarded to the bidder whose bid is in the best interests of the project and the road commission, based on unit prices.
The contractor must be prequalified by the Michigan Department of Transportation for the work to be performed. Bidders must submit written evidence of their qualifications, including financial data, previous experience, and current commitments.
Liquidated damages may be assessed for each day after the substantial completion date that the work remains substantially incomplete, and for outstanding punch list items.
Bidders are responsible for visiting the site and becoming familiar with all conditions that may affect the cost, progress, and performance of the work.
Written notice of a dispute must be given not later than 90 days after the occurrence giving rise to the dispute becomes known or should have become known.
More than one bid for the same work from an individual or entity under the same or different names will not be considered. Reasonable grounds for believing that any bidder has an interest in more than one bid may be cause for disqualification.
