Delivery will be made within 2 days after receipt of order (ARO). Agency will contact vendor at least 24 hours prior to request delivery. Minimum delivery is 24 tons per load.

Payment is to be made within 30 days after receipt of properly executed invoice or delivery, whichever is later. Discounts for payment made within 30 days. Discounts for payment made in less than 30 days, of less than 1, or applicable to an indefinite quantity contract will be accepted but will not be an award consideration.

It is the intent of the state to award this contract on an individual basis to the lowest responsive, responsible bidders meeting the specifications. The state further reserves the right to reject individual line items from the award.

Failure to deliver within the time specified or to provide the services as specified in the bid will constitute a default and may cause cancellation of the contract. Where the state has determined the contractor to be in default, the state reserves the right to purchase any or all products or services covered by the contract on the open market and to charge the contractor with cost in excess of the contract price.

The state of Louisiana has the right to terminate the contract immediately for reasons such as misrepresentation, fraud, conflict of contract provisions with statutory provisions, abusive or belligerent conduct, intentional violation of the procurement code, or any listed reason for debarment. The state may also terminate for convenience with 30 days written notice.

Unless otherwise directed, materials shall be delivered by 9:00 am, provided a 24-hour notice is given by the department. Failure to perform shall be the cause for cancellation of any order at no charge to the city.

Invoices submitted to the city shall be payable sixty 60 days from the time of receipt by the city. All invoices submitted must reflect pricing as per the enclosed bid proposal pages in order for payment to be rendered i. e. , initial price, discount, final price, etc.

Final evaluations will be determined by lowest unit costs and ability to provide delivery service. The city reserves the right to award this contract in part or full to one or multiple bidders to increase or decrease quantities in the best interest of the city.

Bidders must be qualified vendors. The board of contract and supply will make the award to the lowest qualified and responsible bidder.

Failure to deliver within the time quoted or failure to meet specifications may result in default. Failure to perform shall be the cause for cancellation of any order at no charge to the city. Additional failure to perform may result in the termination of any future orders for materials.

Failure to follow instructions could result in information considered private being posted to the city's open meetings portal. Failure to meet specified deadlines, follow specific submission instructions, or enclose all required documents with all applicable signatures will result in disqualification, or in an inability to appropriately evaluate bids.

The closing date for the solicitation will be June 22, 2026, at 10:00 AM EST.
