Sealed bids must be delivered no later than 2:50 p. m. on June 29, 2026. Sealed bids must be delivered to owner as specified in section 00 21 13 instructions to bidders nolater than 2: 50 p. m. on june 29, 2026 to be accepted.

Bidders must be prequalified under the annual prequalification of contractors for pressurized water mains. Bids submitted by contractors who have not been prequalified will not be considered.

Award will be made to the bidder who, in the judgment of the Borough of Totowa, is the lowest responsible bidder.

The accepted bidder must sign the contract within ten (10) days after the notice of award or forfeit his bid security.

Contractor must complete services within 90 business days from the contract award date.

TMD will pay contractor on the basis of itemized invoices submitted to and approved by TMD. Texas Government Code Chapter ****, the Prompt Payment Act, will govern payment and accrual of interest on any overdue payments.

Contractor must warranty all workmanship on all materials and labor for a period of one year beginning with the date of completion or manufacturers standard warranty on equipment, whichever is longer. Contractor must respond to any warranty call within a 24-hour period and have 14 business days to replace defective products.

TMD will evaluate responses based on best value, considering price, compliance with specifications, quality, reliability, delivery timeframe, and indicators of probable performance.

Respondents must be highly qualified contractors and must perform all work inspections and repairs in strict accordance with all current fire and life safety codes. Technicians must be properly licensed in accordance with the state of Texas requirements. Required licenses include NFPA license, State of Texas license, and City of El Paso backflow registration.

If contractor fails to comply with the terms of the contract, TMD may withhold contractor payment. If noncompliance results in TMD purchasing goods or services from another entity to remedy the noncompliance, TMD will deduct those costs from contractor payment.

Two mandatory site visits are scheduled for July 7 and July 8, 2026, from 9:00 AM to 10:00 AM at Fort Bliss, **** Montana Avenue, El Paso, Texas **** to attend one of the site visits will result in disqualification.

The last day to submit written questions for clarification is July 10, 2026, at 2:00 PM.

Failure to attend a mandatory site visit will result in disqualification. Failure to sign the document will disqualify the response. Making false statements may result in disqualification, contract cancellation, or state debarment.

Phase A is to be substantially complete in 120 days from the notice to proceed, and finally complete in 150 days. Phase B is to be substantially complete on or before May 14, 2027, with final completion within 30 days of substantial completion.

Progress payments will be made monthly, with 95% of work completed and 95% of materials and equipment costs paid, less retainage. Final payment will be made within sixty 60 days after the contract is completed satisfactorily and finally accepted by the owner.

Contractor warrants and guarantees to owner and engineer that all work will be in accordance with the contract documents and will not be defective within two years of substantial completion or such longer period of time in accordance with paragraph **** of the standard general conditions of the construction contract section c700.

In evaluating bids, owner shall consider the qualifications of the bidders, whether or not the bids comply with the prescribed requirements, alternates and unit prices if requested in the bid forms. Owner reserves the right to reject any and all bids, to waive any informalities or technicalities, and to negotiate contract terms with the successful bidder.

Each bidder must submit written evidence of their qualifications to perform the work by executing the attached bidder evaluation criteria form. Bidders may be required to submit evidence that they have practical knowledge of the particular work bid upon, and that they have the financial resources to complete the proposed work.

Contractor shall pay to the owner, as liquidated damages and not as a penalty, $1,**** per day for each day of delay in completing all or any designated portion of the work within the time set forth in the agreement. The aggregate liability for liquidated damages shall not exceed 50% of the contract price.

It is the responsibility of each bidder to visit the site to become familiar with local conditions that may affect the cost, progress, performance, or furnishing of the work. On request in advance, owner will provide each bidder access to the site to conduct such explorations and tests as each bidder deems necessary.

No right to claim mistake shall exist for bidder following the twenty-four 24 hour period after the bid opening.

If a bidder withdraws their bid after the 24-hour period following bid opening due to a material and substantial mistake, they will be disqualified from further bidding on the work of this contract.
